It is recommended that the Council APPROVE the Memorandum Understanding (MOU) and authorize the Mayor to enter the City
Carlsbad as a signatory agency to the MOU for inter-agency tr,
coordination.
ITEM EXPLANATION
Over the past two years staff members of several North San Die
County cities and agencies have been meeting informally to wc
toward coordination of all trail plans in the North San Dic County area. The group has produced a map of the North County ai that consolidates all of the existing and planned trails onto t map,

This MOU will provide the guidelines and structure necessary allow the formation and operation of the North San Diego Coui
Regional Trail Committee ("the committee") . The committec purpose will be to: coordinate commuter and recreational tr,
links and associated facilities; to research and pursue financi and planning mechanisms to plan, acquire, develop, maintain e
patrol trails and associated open space corridors; to genere
volunteer support; and encourage and assist in the development integrated processing procedures forthe preservation oftrails E

trail coordination. Such coordination will reduce possil: problems such as one agency locating a trail along one side oj riparian corridor while the adjacent jurisdiction locates the trz on the other side of the corridor, preventing a desired regior connection.

RECITALS
A. The signatory public agencies to this memorandum of
understanding desire to establish a framework for the coordinated
planning, alignment, design and development of trails within North San Diego County.

agencies. This memorandum of understanding establishes a frameworl
for the creation and responsibilities of the Committee.
E. This memorandum of understanding does not establish a contract between any of the signatory public agencies nor shall th. memorandum be construed to be an agreement for the joint exercise ( powers or creating a joint powers agency under the provisions of Government Code Section 6500 et seq. Each signatory public agency shall retain full regulatory authority with respect to the subject matter of this memorandum of understanding and full discretionary
authority with respect to the provision of trails within their
respective jurisdictions.

Therefore, in furtherance of the goals set forth in the Recitals the signatory public agencies set forth their mutual
understanding as follows:
THE COMMITTEE
1. The chief administrative officer (e.g. City Manager,
Chief Executive Officer, Executive Director, etc.) of each signato public agency will appoint a member (and an alternate) of the agent staff to serve as a member of the committee. The committee shall 1 established as soon as three members of the committee are appointec

c. Pursue financial and other support from public agencies (including agencies of the state and federal government), communit: service groups, educational institutions, businesses and individua. to supplement funding by the respective signatory public agencies.
d. Generate volunteer support.
e. Encourage and assist in the development of integrated processing procedures for the preservation of open space corridors
and trails through the planning processes of each of the signatory
public agencies.
f. Draft proposed ordinances, plans and other implementatic documents for consideration by the signatory public agencies.
g. Pursue applications for grant funding for regional trai:

or joint exercise of powers agreement and make a recommendation to the signatory public agencies regarding the desirability of such ai authority agreement.

The Committ may establish by-laws which are not inconsistent with this memorandum of understanding. Meetings of the committee shall be open to the public but need not be conducted in accordance with th
Ralph M. Brown Act. A majority of the members of the committee
shall constitute a quorum for the transaction of any business of t committee. Formal actions of the committee shall require an
affirmative vote by a majority of the quorum.
PLANNING ACTIVITIES
4. Trail planning activities by the various signatory pub1 agencies should be coordinated with the goal of establishing a
regional public trail network within North San Diego County.
Particular emphasis should be placed on establishing connections between trail systems within the boundaries of the various signatc agencies and on avoiding conflicts in trail types, uses and desigr where such conflict would inconvenience or endanger the public.
Where feasible and consistent with public safety, easements for
major utility and transportation facilities (other than streets)
should be made available for joint use as trails. Cities and the
County should consider the incorporation of trails as a
transportation and recreation option within the Circulation or otk
appropriate elements of the agency's general plan. Each signatory
agency should consider the trail planning activities of the other
signatory agencies in developing trail routes within their
respective jurisdictions.
5. Each signatory public agency agrees to refer applicable
proposals for major land developments to the Committee for comment regarding trail program implementation as a part of the developmen review process.
6. The signatory public agencies agree to coordinate regional trails planning with land use regulations while maintaini
local land use control.
FUND I NG
7. The signatory public agencies will each bear their own
costs of implementing this memorandum of understanding. Expenses for copying, document preparation, mailing or other similar common costs should be shared equally among the signatory agencies, or rotated between the agencies on a regular basis.
8. The committee should pursue grant or other funding to
support its activities.

f MISCELLANEOUS
9. This memorandum shall become effective upon the executil by any three of the public agencies which are listed in the title hereof. Any public agency listed in the title hereof may become a signatory public agency at any time or may withdraw as a signatory public agency at any time.
10. Each signatory agency shall be solely responsible for i
own acts or omissions taken with respect to activities within its
jurisdiction with respect to the subject matter of this memorandum No signatory agency shall be liable with respect to any comments o requests whether implemented or not, pertaining to trail activitie of any other public agency. Where trails of one public agency
adjoin or abut the trails or property of another public agency, liability to third persons with respect to personal injury or property damage shall be determined according to ordinary principii of law without regard to this memorandum.
