HomeMy WebLinkAbout1992-04-14; City Council; 11646; Evans PointRECOMMENDED ACTION: If Council concurs your action is adopt Resolution No. qk-/Cq approving the certification of EIR 91-2, and approving GPA 91- 3/LCPA 91-l/ZC 91-6/CT 91-3/HDP 91-3/SUP 91-2; and adopt Ordinance No. NS-195 approving ZC 91-6. ITEM EXPLANATION The City Council at your meeting of April 7, 1992 directed our office to prepare documents certifying the Environmental Impact Report and approving the General Plan Amendment, Local Coastal Plan Amendment, Zone Change, Tentative Tract Map, Hillside Development Permit and Special Use Permit as noted above. As determined by vote of the City Council, Condition Nos. 23 and 96(F) of CT 91-3 have been amended. The appropriate resolution is attached. The Council should satisfy itself that the findings and conditions as recommended by the Planning Commission and as modified by the Council accurately reflect your intentions in the matter. That the above recitations are true and correct. 2. That the findings of the Planning Commission in Resolution No. 3348 on file with the City Clerk and incorporated herein by reference, recommending certification of Environmental Impact Report EIR 91-2, are the findings of the City Council in this matter. 3. That the findings of the Planning Commission in Resolution No. 3349, on fkle with the City Clerk and incorporated herein by reference, are the findings of the City Council in this matter and that the Land Use Element of the General Plan GPA 91-3 be amended from RL on 38.7 acres and RLM on 89.4 acres to OS on 59.4 acres and RLM on 68.7 acres on property generally located on the southwesterly side of El Camino Real between the future extension of Cannon Road and existing Camino Hills Drive. 4. That the findings of the Planning Commission in Resolution No. 3350, on file with the City Clerk and incorporated herein by reference, are the findings of the City Council in this matter and that the Local Coastal Plan LCPA 91-1 be amended from PC to the RLM and OS designations proposed by the General Plan Amendment. 5. That the Tentative Tract Map CT 91-3 of this project is approved and that the findings and conditions of the Planning Commission in Resolution No. 3352, on file with the City Clerk and incorporated herein by reference, are the findings and conditions of the City Council with the exception of the following: A. That Condition No. 23 be amended to read as follows: "Existing onsite trees within proposed open space shall be retained wherever possible and shall be trimmed and/or topped. Dead, decaying or potentially dangerous trees shall be approved for removal at the discretion of the Planning Department during the review of a Master Plan submitted showing existing onsite trees. Those trees which are approved for removal shall be replaced on a tree-for-tree basis as required by the Planning Department. The trees provided as a result of this condition shall not satisfy any other tree conditions, including those specified in Condition Nos. 24 and 32." follows: B. This action is final the date this resolution is adopted by the City Council. The provision of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial Review" shall apply: "NOTICE TO APPLICANT" "The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16.
