ITEM EXPLANATION On July 25, 1991 a City of Carlsbad Police Officer was involved in a traffic accident with a City of Oceanside Officer. The accident resulted from a police action involving both the City of Carlsbad and Oceanside Police Departments. The City of Oceanside had originally filed a claim with the City of Carlsbad for compensation for both the property damage and the workers compensation costs related to the incident. Oceanside has since dropped their claim for workers compensation costs and has agreed to settle for payment of $13,627.50 representing the value of the police unit damaged in the accident. We have received a signed release from the City of Oceanside. Staff is asking the City Council to adopt the attached resolution accepting the proposed settlement, and authorizing the City Manager to issue a check for $13,627.50 to the City of Oceanside. F!ISCAL IMPACT The amount of this claim will be paid from the City's Liability Self-Insurance Fund. Sufficient funds exist to cover this payment. The vehicle is expected to have a salvage value of $2,500 which will reduce our net costs to approximately $11,100. EXHIBITS Resolution No. Oceanside. approving the settlement of a claim for damages filed by the City of 9%-rr3 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 96-117 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE SETTLEMENT OF A CLAIM FOR DAMAGES FILED BY THE CITY OF OCEANSIDE. WHEREAS the City of Oceanside has filed a claim for damages related to an incident involving Police Officers employed by the City of Carlsbad and City Oceanside which occurred on July 25, 1992, and WHEREAS the claim for damages amounting to $13,627.50 for replacement of an Oceanside Police patrol unit has been determined to be both reasonable and timely, and, NOW, THEREFORE, be it resolved by the City Council of the City of Carlsbad, California that the City Manager is hereby authorized to issue a check in the amount of $13,627.50 in settlement of the above claim.
