I MTG.s-19-92 SERVICE ON RECYCLED PAPER CITY A' DEPT. PCH CITY M RECOMMENDED ACTION: Staff recommends Council adopt Resolution No. q a- j3 0 , accepting the bid prc of Premier Image and approving an Agreement with said company for speedy copy I for the period of one year commencing July 1, 1992 through June 30, 1993 with the to renew for two additional one (1) year periods. ITEM EXPLANATION All City departments require speedy copy service for their various manuals, reports, p< and miscellaneous batch copying. The Purchasing Department compiled specificatior estimated needed quantities for the speedy copy service bid proposal. If the City contract with one vendor for this service, a considerable time saving is realized by elimi repetitious quotations as well as expediting the copying process. In accordance with Section 3.28.120 of the Municipal Code, Notice to Bidders as put and Request for Bids was made for speedy copy services on recycled paper of twen vendors. From the thirteen responses, Premier Image, 9705 Carroll Center Road, San CA 921 26, was selected as the lowest, most responsive bidder for the speedy copy se FISCAL IMPACT Departmental budgets contain sufficient funds and are available in their respective acc for the speedy copy service. I WITNESSETH WHEREAS, the City does find that the proposal tendered by the Contractor fo annual blueprinting and/or speedy copy services was a responsive proposal and of higj standards; WHEREAS, the City does further find and determine that it would be in the be: interests of the City that said proposal be accepted and the contract be awarded to th Contractor; NOW, THEREFORE, for and in consideration for the mutual covenants and promisf of the parties hereto and upon the express terms and conditions thereinafter set forth, is agreed by and between them, and each with the other as follows: 1. This Agreement shall consist of and include the following document attach€ hereto, as Exhibit "A", Bid tabulation, 1 0 0 -. ”- 1 2. The Contractor agrees to furnish all labor and materials for the blueprintk and/or speedy copy services submitted in proposal dated April 14, 1992. 3. The Contractor shall provide pick-up and delivery service as required by tE. City. 4. The Contractor shall furnish blueprinted and/or copied matter within five (5 working days after receipt of material. 5. The Contractor shall obtain and pay for a City of Carlsbad business kens prior to signing this Agreement. i 6. The Contractor shall comply with all federal, state, county and city statutes ordinances and regulations, including workers’ compensation and th~ Immigration Control Act of 1986. 7. This Agreemeqt shall be for a period of one (1) year commencing on July 1: 1992 and ending on June 30,1993. At the end of one (1) year, the City ha: the right to re-bid or renew the Agreement for two (2) additional one (1) year periods. 2 , 0 0 w, 1- 8. The Contractor shall obtain and maintain policies of general liabili? insurance, automobile liability insurance, personal property insurance, an a combined policy of workers’ compensation and employeis liabilit insurance from an insurance company authorized to do business in the Stat of California and with a Best rating of at least A-:V in an insurable amour of not less than one million ($1,000,000) each. The Contractor shall furnis to the City a copy of the Certificates of Insurance issued by such insuranc company prior to the beginning of the Contract. This insurance shall be i force during the life of this Agreement and shall not be canceled withoi thirty (30) days prior written notice to the City sent by certified mail. 9. It is expressly understood and agreed that the Contractor herein named i the furnishing of all labor and materials provided in this Contract, is actin as an independent Contractor and not an agent, servant or employee of tE City. I 10. This agreement or any part thereof shall not be assigned by Contract( without prior written consent of the City. 11. This Agreement may be amended or modified only by written agreemei signed by both parties, and failure on the part of either party to enforce ar provision of this Agreement shall not be construed as a waiver of the rig1 to compel enforcement of such provision or provisions. 3 0 0 +, b .- 12. The Contractor shall be aware of the requirements of the Immigratio Reform and Control Act of 1986 and shall comply with those requirement. including but not limited to verifying the eligibility for employment of a agents, employees, sub-contractors and consultants that are included in thi Agreement. 13. Once each year, after the first six (6) months of this Agreement, up0 written request by the Contractor and approval of the Purchasing Office said prices shall be subject to change in accordance with the Consumer Pric Index, San Diego as published by the U.S. Department of Labor, based 01 one-half of the percentage change in the index from the first month of thi Agreement to each succeeding anniversary thereof. .... .... .... .... .... t I .... .... .... .... 4 0 0 r. 7. *- 4 14. This Agreement may be terminated by either party by giving thirty (30) day written notice to the other, and this Agreement shall terminate forthwit! thirty (30) days following the date such notice is given. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of C California, as follows: 1. That the bid of PREMIER IMAGE, 9705 Carroll Center Road, San Diego Ci regarding the annual speedy copy service is hereby approved. 2. That an Agreement between the City of Carlsbad and Premier Image fa speedy copy service on recycled paper for the period of one year commencing July through June 30, 1993 with the option to renew for two additional one (1) year periods increase not to exceed 10% of the prices in effect at the end of the initial contract perioc of which is attached, Exhibit “A”, and made a part hereof, is hereby approved. 3.
