I MTG. 5-15 -92 SERVICE CITY A' DEPT. PCH CITY M RECOMMENDED ACTION: Staff recommends Council adopt Resolution No. q a- 13 1 , accepting the bid p of North County Blueprint Co., Inc. and approving an Agreement with said comp annual blueprint service for the period of one year commencing July 1, 1992 throug 30, 1993, with the option to renew for two additional one (1) year periods. ITEM EXPLANATION Blueprinting service is needed by various City departments. Engineering, Plannil Community Development require blueprints on a routine basis and other departmen require contract documents containing blueprints when following the bidding proce! In accordance with Section 3.28.120 of the Municipal Code, Notice to Bidders was pu and Request for Bids was made of twenty-four vendors. From the six responses County Blueprint Co., Inc., 2205 Faraday Avenue #K, Carlsbad CA 92008, was selec the lowest, most responsive bidder for the blueprinting service. FISCAL IMPACT Departmental budgets contain sufficient funds and are available in their respective ac for the blueprinting service. EXHIBITS 0 0 ,. I* AGREEMENT day of MAY THIS AGREEMENT, made and entered into this 19th , 1992, by and between the CITY OF (XUSBAD, California, a municipa corporation, hereinafter referred to as Wty" and - ~r~~Qw~J~~~EaQ referred to as "Contractor". WITNESSETH WHEREAS, the City does find that the proposal tendered by the Contractor fc annual blueprinting and/or speedy copy services was a responsive proposal and of hig standards; WHEREAS, the City does further find and determine that it would be in the be interests of the City that said proposal be accepted i3nd the contract be awarded to ti Contractor; NOW, THEREFOF, for and in consideration for the mutual covenants and promis of the parties hereto qd upon the express terms and conditions thereinafter set forth, is agreed by and between them, and each with the other as follows: 1. This Agreement shall consist of and include the following document attach hereto, as Exhibit "Att, Bid Proposal. 1 0 0 ._ 2. The Contractor agrees to furnish all labor and materials for the blueprintin! and/or speedy copy services submitted in proposal dated April 14, 1992. 3. The Contractor shall provide pick-up and delivery service as required by th City. 4. The Contractor shall furnish blueprinted and/or copied matter within five (5: working days after receipt of material. 5. The Contractor shall obtain and pay for a City of Carlsbad business licensc prior to signing this Agreement. 6. The Contractor shall comply with all federal, state, county and city statutes, ordinances and regulations, including workers’ compensation and thc Immigration Control Act of 1986. 7. This Agreement shall be for a period of one (1) bear commencing on July 1 1992 and ending on June 30,1993. At the end of one (1) year, the City ha: the right to re-bid or renew the Agreement for two (2) additional one (1) year periods. t ; 2 9 0 9. 8. The Conkactor shall obtain and maintain policies of general liabilit insurance, automobile liability insurance, personal property insurance, an a combined policy of workers' compensation and employer's liabilit insurance from an insurance company authorized to do business in the Stat of California and with a Best rating of at least A-:V in an insurable amour of not less than one million ($1,000,000) each. The Contractor shall furnis to the City a copy of the Certificates of Insurance issued by such insuranc company prior to the beginning of the Contract. This insurance shall be i force during the life of this Agreement and shall not be canceled withoi thirty (30) days prior written notice to the City sent by certified mail. 9. It is expressly understood and agreed that the Contractor herein named 1 the furnishing of all labor and materials provided in this Contract, is actir as an independent Contractor and not an agent, servant or employee of t€ City. 10. This agreement or any part thereof shall not be assigned by Contract( without prior written consent of the City. 11. This Agreement may be amended or modified only by written agreeme signed by both parties, and failure on the part of either party to enforce a provision of this Agreement shall not be construed as a waiver of the rig to compel enforcement of such provision or provisions. 3 f* e 0 12. The Contractor shall be aware of the requirements of the hmigratio Reform and Control Act of 1986 and shall comply with those requirement: including but not limited to verifying the eligibility for employment of a agents, exhployees, sub-contractors and consultants that are included in th Agreement. i 13. Once each year, after the first six (6) months of this Agreement, upc written request by the Contractor and approval of the Purchasing Office said prices shall be subject to change in accordance with the Consumer Pric Index, San Diego as published by the US. INC. FOR ANNUAL BLUEPRINT SERVICE. 0 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of C California, as follows: 1. That the bid of NORTH COUNTY BLUEPRINT CO., INC., 2205 FARADAY 1 #K, Carlsbad CA 92008, regarding the annual blueprint service is hereby approved. 2. That an Agreement between the City of Carlsbad and North County Bluei Inc. for annual blueprint service for the period of one year commencing July 1, 1992 June 30,1993, with the option to renew for two additional one (1) year periods, with an not to exceed 10% of the prices in effect at the end of the initial contract period, a copy is attached, Exhibit "A", and made a part hereof, is hereby approved. 3. The Contractor shall furnisl to the City a copy of the Certificates of Insurance issued by such insurancc company prior to the beginning of the Contract. This insurance shall be i~ force during the life of this Agreement and shall not be canceled withou thirty (30) days prior written notice to the City sent by certified mail. 9. It is expressly understood and agreed that the Contractor herein named i the furnishing of all labor and materials provided in this Contract, is actin as an independent Contractor and not an agent, servant or employee of th City. 10. This agreement or any part thereof shall not be assigned by Contractc without prior written consent of the City. 11. This Agreement may be amended or modified only by written agreemei signed by both parties, and failure on the part of either party to enforce ar provision of this Agreerneh shall not be construed as a waiver of the rig1 to compel enforcement of such provision or provisions. 3 0 0 12. The Contractor shall be aware of the requirements of the Immigration Reform and Control Act of 1986 and shall comply with those requirements including but not limited to verifving the eligibility for employment of al agents, employees, sub-contractors and consultants that are included in thi: Agreement. 13. This Agreement may be terminated by either party by giving thirty (30) days written notice to the other, and this Agreement shall terminate forthwith thirty (30) days following the date such notice is given.
