RECOMMENDED ACTION:
CARLSBAD STATE BEACH
1. Authorize staff to enter into an agreement with the California State
Department of Parks and Recreation to keep parking free at Carlsbad State
beach in the 1992-93 fiscal year.
Appropriate $36,000 from the City Council Contingency Fund to provide for
free parking at Carlsbad State Beach.

ITEM EXPLANATION
On June 16, 1992 the City Council adopted the 1992-93 Operating Budget. As part of this
budget, the Council allocated $36,000 from the Contingency Account to pay the State
Department of Parks and Recreation for continued free parking at Carlsbad State Beach.
This will ensure that fee collection devices are not installed at the Tamarack Avenue lot
during the 1992-93 fiscal year. Staff is recommending that payments be made quarterly,
in order to monitor the progress of the Surfrider Foundation lawsuit against the State. If
it is judicially determined that the imposition of day use parking fees at state beaches is
improper, the City’s obuigation to pay the State would cease.
FISCAL IMPACT
$36,000 from the Contingency Fund.

AGREEMENT REGARDING DAY USE PARKING FEES
CARLSBAD STATE BEACH
THIS Agreement is made and entered into this 14 th day of JULY ,1992 by a

RECITALS
1. The STATE proposes to collect day use parking fees at the Tamarack Aven
parking lot at Carlsbad State Beach for the purpose of offsetting operation a
maintenance costs of state beaches.
2. The CITY opposes imposition of fees at this location and has agreed to providi
City funds to help offset operation and maintenance costs of state beaches for the fisc
year 1992-1 993.
AGREEMENTS
1, Term of Agreement: This Agreement shall begin on July 1, 1992 and shall contin
through June 30, 1993.
2. Collection of Dav Use Parking Fees: The State shall not impose or collect day L
parking fees at the Tamarack Avenue parking lot during fiscal year 1992-93.

3. City Funds: The City shall make quarterly payments to the State in the amount c
$9,000 during fiscal year 1992-93. Payment shall be made within 30 days of the end c
each quarter. Total payments shall not exceed $36,000.
4. Termination of Pavments: Quarterly payments and the City’s obligation to pay WI

RESOLUTION NO. 92-226
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA AUTHORIZING AN
AGREEMENT WITH THE CALIFORNIA STATE
DEPARTMENT OF PARKS AND RECREATION AND THE
EXPENDITURE OF FUNDS FOR MAINTAINING FREE
PARKING AT THE CARLSBAD STATE BEACH IN
FISCAL YEAR 1992-93
The City Council of the City of Carlsbad, California, does hereby resolve as follow!
1. That the agreement regarding day use parking fees at Carlsbad State Beact-
hereby approved.
2. That the Mayor of the City of Carlsbad is hereby authorized and directed
execute this agreement for and on behalf of the City of Carlsbad.
3. That the City Council appropriates $36,000 dollars from the Contingency Fund
the State of California Department of Parks and Recreation to fund this agreement. Fur
shall be disbursed in quarterly installments of $9,000.
4. This resolution shall not act in any way, or be deemed to be, a waiver of any of
City’s rights or abilities to obtain or pursue legal, legislative, or other methods to oppc
the continued implementation of parking fees.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of
