ITEM EXPLANATION: Bristol Cove Partners II have requested a reversion to acreage of their solely owned Parcel Map No. 16262. The owner-applicant has cited inability to obtain financing for the project as their reason for the request. The project is located on the south side of Harrison Street westerly of Adams Street. The project is a one lot condominium project containing four units. If reverted the property would become a legally conforming unimproved lot with no condominium units approved. The reversion will also require the rescinding of Condominium Permit CP 67-2 and Hillside Development Permit HDP 69-42 which were approved with the parcel map. Such action has been incorporated in the approving resolution. The City will retain a four foot wide street dedication along the south side of Harrison Street and a 15 foot wide easement for a walking trail along an existing sewer easement. These dedications were made on Parcel Map 16282 and are reserved from this reversion to acreage. There is a IO foot wide sewer easement dedicated to the City on Parcel Map 16282 that will not be retained with this reversion to acreage. This easement is not needed for any present or future public purposes. This easement was dedicated for the sewer system needed to serve Parcel Map No. 16282 and the condominium project approved with the parcel map. This reversion to acreage will also nullify the condominium project, Therefore, this particular sewer easement will not be needed. The owner-applicant also requested release of obligations under the subdivsion improvement agreement and return of any unused fees. There are no unused fees to be returned. Per Municipal Code Section 20.40.070 the release of obligations under the agreement have been incorporated in the approving resolution. FISCAL IMPACT: The loss of potential fees represented by this approval will be offset by fees required of any new proposal for development on this property. zz u 22 2 I EXHIBITS: 1. Location Map. 2.
