U&M FOR BIDS RECOMMENDED ACTION: Adopt Resolution No. 93-260 rejecting bids, approving revised contract documents, special provisions and specifications and authorizing the City Clerk to readvertise for bids for Contract No. 92-5 to provide for maintenance of the Buena Vista Channel. I ITEM EXPLANATION: In fiscal year 89-90, Council approved the formation of the Buena Vista Channel Benefit Assessment District in accordance with provisions of the “Benefit Assessment Act of 1982” (Government Code Sections 54703-54718). The formation of the Buena Vista Benefit Assessment District was requested by Plaza Camino Real, Hughes North County Associates, and Hughes North County Associates II to provide a proper funding mechanism for an effective, consistent means of clearing the Buena Vista Channel which is located south of Highway 78 between El Camino Real and the Jefferson Street bridge. The channel flows in a westerly direction into the Buena Vista Lagoon and ultimately empties into the Pacific Ocean. Property owners adjacent to the channel pay annual assessments that pay for channel maintenance. The Utilities and Maintenance Department administers the maintenance programs which are required to keep the channel clear and free flowing. The maintenance program consists of both minor and major work. Minor maintenance work is performed on the channel on an as needed basis with major vegetation removal occurring every two to three years. The proposed contract would be major in nature and consist of removing silt, vegetation and all other accumulated debris necessary for proper drainage of the entire channel area within the boundaries of the district. The last major work performed in the channel occurred in 1988, when the channel west of Plaza Camino Real was cleared. On December 10, 1991, the City Council adopted Resolution No. 91-393 approving plans and specifications and authorizing the advertisement of bids for the Maintenance of the Buena Vista Channel, Contract No. U/M 92-5. Bids were to be opened on March 5, 1992. Prior to the bid opening, a pre-bid meeting was held on-site to discuss possible methods of work, necessary permits, and to answer any questions which contractors might have regarding this project. Also invited to the on-site pre-bid meeting were representatives from May Stores and Hughes North County, both principal land holders within the Buena Vista Channel Assessment District. Neither May Stores nor Hughes North County representatives were present at that pre-bid meeting. Several contractors attended the meeting, however, only one, Roberts Earthmoving, submitted a bid. - PAGE 2 OF AJ3# ll,SY& - On March 5, 1992, five (5) sealed bids were received as follows: E. A. Rutledge Inc. $122,000 American Processing Company 139,250 Commercial Contractors Inc. 140,900 Don Hubbard Contracting Company 173,500 Roberts Earthmoving 388,000 Prior to recommending an award, staff met with representatives of the low bidder, E.A.Rutledge, Inc., to discuss the proposed methods of work. Again, staff invited representatives from May Stores and Hughes North County to that meeting to discuss any concerns they might have. During the meeting, certain conditions were explained to the contractor by the representative of Hughes North County Properties that heretofore were unknown by City staff or the bidders. These conditions concerned insurance, rent for the use of Hughes North County property for drying dredged material, and assurances that any and all toxic substances discovered in the material would be disposed of by the bidding contractor. These conditions, unknown at the time the contractors were preparing bids, changed the scope of work for the contract and would constitute a significant financial hardship on the bidders. In view of the changed conditions, staff has prepared revised specifications and contract documents that take into consideration the changed conditions and incorporate a requirement for mandatory bidder attendance at a pre-bid conference. Thus, staff recommends that per City of Carlsbad Municipal Code Section 3.28.120 the City Council reject bids on Contract No. U/M 92-5, approve revised specifications and contract documents and authorize readvertisement of Contract No. U/M 92-5. FISCAL IMPACT: Funds are appropriated and available in the amount of $293,000 in the Buena Vista Channel Special Assessment Fund. The staffs cost estimate for Contract No. U/M92-5 is $175,000. All costs will be covered by the aforementioned fund budget. There will be no cost to the City. EXHIBITS: 1. Resolution No. qa- 260 2. Map of Assessment District 3. RESOLUTION NO. 92-260 A RESOLUTION OF THE CITY COUNCIL OF THE CITYOF CARLSBAD, CALIFORNIA, RFJECI-ING BIDS AND AUTHORIZING READVERTISEMENT OF BIDS FOR THE MAINTENANCE OF THE BUENA VISTA CHANNEL, CONTRACI- NO. U/M 92-S. WHEREAS, the CITY COUNCIL of the CITY OF CARLSBAD, CALIFORNIA, has previously authorized the advertisement of bids for the Maintenance of Buena Vista Channel, Contract No. U/M 92-5; and WHEREAS, five (5) sealed bids were received on March 6, 1992 for said project; and WHEREAS, staff has determined the bids to be invalid. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That in accordance with Section 3.28.120 of the City of Carlsbad Municipal Code, the City Council does hereby reject all bids received for said project. 3. ‘. That the City Council does hereby authorize staff to reassemble a bid package for said project. 4.
