RECOMMENDED ACTION:
Introduce Ordinance N0.jV.S -A/3 amending Title 10 of the Carlsbad Municipa
to establish parking restrictions during certain times to facilitate street sweeping.
ITEM EXPLANATION:
The City of Carlsbad contracts with a commercial street sweeping firm to sweep (
streets twice a month. Streets are swept regularly for several reasons, including, t
limited to:

3. Visual and aesthetic benefits.

Removal of curbside dirt, standing water, oil and grease, etc.
To help keep the storm drainage system free of materials that
eventually enter into the lagoons and ultimately the ocean.
Removal of material that may cause undesirable smells.
Each month several complaints are received when streets or street segments i
swept due to parked vehicles. When vehicles are parked overnight on the
sweeping route, the street sweeper must pass around the vehicle, resulting in a SE
of street not being swept. When the same segment or street is continually bypassc
to the presence of parked vehicles, complaints are initiated and a service being F
is not completed.
Implementation of a street sweeping ordinance will allow staff to determine lo(
where signs are required to be posted to prohibit parking during certain hours on t
that the street will be swept. An important element of the program will be enforc
of the ordinance to insure compliance with the parking restriction.
Staff will initially attempt to obtain voluntary compliance by placing warning notii
vehicles violating the ordinance during the first several weeks after the effectivt
Police Department personnel will begin issuing citations to vehicles parked in viol:
the ordinance after the warning period. The ordinance would not be applic;
commercial vehicles on residential streets making deliveries or pickups during
sweeping hours.
Due to the location where complaints are generated, the initial efforts for posting
for street sweeping purposes would be in the Bristol Cove area and also v
Interstate Highway 5 between the Agua Hedionda Lagoon and Buena Vista L(
These two locations have many vehicles parked on the street during regular
sweeping hours.
FISCAL IMPACT:
The two initial areas will require $13,000 for fabrication and installation of the
Funding for this initial effort is in the budget of the Utilities and Maintenance Depa
No additional staff will be required to enforce the ordinance at this time. No estir
available for the cost of using current staff for enforcement.

ORDINANCE NO. NS-213
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 1 0, CHAPTER
10.40 OF THE CARLSBAD MUNICIPAL CODE BY THE
ADDITION OF SECTION 10.40.1 50 TO PROHIBIT PARKING AT
CERTAIN TIMES FOR STREET SWEEPING HOURS.
The City Council of the City of Carlsbad, California, does ordain as follows:
Section 1. That Title 10, Chapter 10.40 of the Carlsbad, Municipal Code is am(
by the addition of Section 10.40.150 to read as follows:
"1 0.40.1 50 Parking Restricted at Certain Times to Facilitate Street Sweeping:
(a) It is unlawful to park or leave parked any vehicle on any
street or portion thereof during the hours and on the day
or days of the month indicated on signs containing the
words "NO PARKING," which signs have been placed in
appropriate locations designating said parking restriction
pursuant to the provisions of this section.
When said markings or signs are in place, no person
shall stop, stand or park a vehicle upon any street or
highway in violation of the restrictions contained on said
signs or markings.
The City Traffic Engineer is authorized to determine the
locations of and to place and maintain, or cause to be
placed and maintained, signs designating the hours
during which, and day or days of the month on which,
parking is prohibited in order to sweep City streets. In
the event temporary signs are employed to prohibit
parking on any street or highway or portion thereof
pursuant to the foregoing, no vehicle parked in violation
of the directions set forth on the temporary signs shall
be removed unless such signs have been erected or
placed on the street or portion thereof at least seventy-
two hours prior to such removal.
Section 10.40.150(a) shall not apply to the parking or
standing of commercial vehicles in a residential district
making pickups or deliveries of goods, wares or
merchandise from or to any building or structure located
on the restricted street or highway, or for the purpose of
delivering materials to be used in the repair, alteration,
re-modeling or reconstruction of any building or
structure for which a building permit has previously been
obtained."

Dear Representatives of the People of Carlsbad,
Shortly, the Council will be asked to approve a new
ordinance proposed by the Traffic Safety Commission:-
Parked cars will be ticketed if they block the street
sweeper !!!
Cost of signs in the two complaining areas -- $13000. Other areas COULD be posted ( at additional cost ).
Suggested method of enforcement -- a patrol officer
or a police aide ( at additional cost ).
The Carlsbad City Council should keep in mind they represe ALL the citizens, who will certainly not welcome additiona restrictions, bureaucracy and expense because 8n area is having a parking problem.
Most complaints come from the high density living area of Bristol Cove. When this project was approved by the Carlsbad City Council, there was no demand for the additional parking allowances that would be required in a high density type living area.

A HORRIBLE BLUNDER BY THE CITY COUNCIL.
Now, there are vehicles parked all along the streets,
blocking services. Taxpayers through-out Carlsbad, will
be asked to bear an additional financial burden and subjec
themselves to further enforcement action and regulation ta
address this mistake.
Once the proposed ordinance is approved by the City Counci although aimed primarily at correcting an ommission , its
provisions could be extended to cover the entire city, a ghastly prospect.
The People of Carlsbad could be ticketed for inadvertant13
parking outside their homes on the day the street sweeper
was due !!! It may not matter if the gutter had been SWE and washed by the homeowner the day before and was perfect
clean.
Creation of further legislation and restrictions to cover earlier mistake and unthrift of taxpayer's funds, would 1
