ITEM EXPLANATION On December IO, 1991, the City Council adopted Resolution No. 91 -1 39 aut the start of the gnatcatcher habitat mitigation planning process for the Ranch Fe Road project. As part of that action, the City Council accepted a deposit f Fieldstone Company to defray the cost of consultants and authorized the City h to execute contracts with the consultants. One of the consultants selected to 1 this project was Regional Environmental Consultants (RECON), Subsequently, it was decided to expand RECON'S role and scope of work. As ir in Exhibit 2, the cost of the additional work will be $28,470. The Fieldstone C has provided an additional deposit in this amount. City Council action on this order is required per section 3.28.172 of the Carlsbad Municipal Code because - amount of RECON'S contract will now exceed $50,000. The total amoun contract with the addition will be $67,170. FISCAL IMPACT There is no fiscal impact to the City as a result of this action because all func been provided by the Fieldstone Company. Added scope of work and cost estimate for RECON. 1 0 0 EXHIBIT 2 RANCHO SANTA FE ROAD HABITAT CONSERVATION PLAN SUPPLEMENTAL SCOPE OF WORK c The following tasks would replace tho- in Items D and F under "Consultant's Obligations" in RECON'S existing contract i*/ith the City of Carlsbad dated February 6, 1992. D. Phase 11, Task 6: Habitat Conservation Plan (HCP) Draft 1. Prepare a draft HCP based on information provided by the City of Carlsbad, the Fieldstone Company and its consultants. All supporting graphics will be provided by the client. The draft HCP will be a submittal to the City of Carlsbad and the U.S. Fish and Wildlife Service (USFWS). Prepare one joint draft environmental assessment and supplemental environmental impact report document (ENSEIR) for the HCP. The EA/SEIR will be prepared based on information and support graphics provided by the client. The draft EA/SEIR will be submitted to the City of Carlsbad and the USFWS. Phase 111, Task 9: Prepare Final Documents 1. 2. F. Prepare a final HCP, incorporating revisions requested by Dr. Atwood, the City and the USFWS. The final HCP will be submitted to the City of Carlsbad and the USFWS. Prepare a final draft EA/SEIR for the HCP based on revisions requested by the City and the USFWS. The final EA/SEIR will be submitted to the City of Carlsbad and the USFWS. 2. A camera-ready copy of the draft HCP and draft EA would be provided to the City for reproduction and distribution to the HCP facilitation team. Both documents would be revised once, based on comments from the facilitation team, reviewing agencies, and City staff, Camera-ready copies of the final HCP and revised EA/SEIR would be provided to the City for reproduction and distribution. At the City's request, RECON also will provide a cost estimate for reproduction of the draft and final HCP and EA. WHEREAS, the City Council on December IO, 1991, directed staff tc a planning effort related to wildlife habitat impacts and mitigation relate Rancho Santa Fe Road project; and WHEREAS, the City Manager executed an agreement with RECOI amount of $38,700 to provide biological consulting services for the n planning effort; and WHEREAS, in order to complete the Habitat Conservation Plan w resulted from the planning effort it is necessary to amend the agreement wit1 to provide additional services at an increased cost of $28,470; and - WHEREAS, the Fieldstone Company has deposited funds in the ai $28,470 with the City to defray the additional cost of RECON’S work; and WHEREAS, this additional deposit shall be included with other funds ( by Fieldstone, and Fieldstone shall be eligible for reimbursement for funds i in excess of its proportional share of costs directly related to the Rancho Road project from any subsequent assessment district formed to finl construction of the road.
