approving a Final Map for Carlsbad Tract No. 89-37,
I ITEM EXPLANATION:
Engineering staff has completed checking the final map of Carlsbad Tract 89-37. This
subdivision is located south of Alga Road north of the Batiquitos Lagoon, west of El
Camino Real and east of Batiquitos Drive. It is comprised of 9 lots with no development
rights.
The final map conforms substantially with the Subdivision Map Act, the Carlsbad
Municipal Code and with the conditions of approval and the tentative map as approved
by the City Council on February 19, 1991, per City Council Resolution No. 91-60.
This map has been found to be consistent with the Growth Management Ordinance and
the requirements of the Local Facilities Management Plan for Zone 19. Currently all
public facilities within or impacted by Zone 19 meet or exceed the adopted performance
standard. For a more complete analysis of the public facilities impact for this project, see
the attached Local Facilities Impact Assessment Form.
The project density is zero du/acres as no development rights were granted on the
tentative map.
The developer has entered into an agreement with the California Coastal Commission,
creating a deed restriction over the open space areas within the subdivision. This deed
restriction prohibits any encroachment for development into said areas in perpetuity.
The developer has contracted with a licensed environmental consultant to provide
construction observation and monitoring services for the mitigation measures required by
the tentative map and the environmental impact report for the subdivision.
The housing element of the City of Carlsbad General Plan has not been adopted by the
City. The developer has entered into an agreement with the City to provide the Aviara
Master Plan’s proportional share of the City’s total obligation for very low, low and
moderate income housing units,
The developer entered into a Park Agreement with the City of Carlsbad on June 1, 1989.
This Park Agreement provided for dedication of 24.2 acres of land by Aviara for park purposes in conjunction with Aviara’s Phase I project. This park dedication was in excess
of the requirements for Phase I so a Park Dedication Credit was established in the
Agreement. A Park Credit Accounting Ledger was established as part of the Park
Agreement to monitor the Park Dedication Credit.
As required by the Park Agreement a updated copy of this ledger is included a part of the
Council agenda package. Due to Phase II not having development rights there is no
change in the park credit at this time.

FISCAL IMPACT:
The public facility fees will be paid by projects that develop in each of the seven planning
areas within the map boundaries. Likewise, the drainage area fees will be assessed at
the time the individual planning areas develops. Public improvements for this project
include a portion of Batiquitos Drive and Kestrel Drive to City Standards and construction
of storm drains and sewer as shown on the improvement plans. No detailed economic
impact analysis of this development has been conducted. Because no development
rights are conferred by approval of this map operating expenses are not expected to
increase.
This project is located within Community Facilities District No. 1 (CFD). Upon recordation
of the final map, the CFD will be apportioned to all lots within the subdivision with the
exception of Open Space Lot Nos. 1 and 2. Due to the approved tentative map not conferring development rights, Lots 3 through 9 within this subdivision have not been
proposed for development to their full potential. Subsequent tentative map will or have
be processed for each of the planning areas (lots 3 through 9). The CFD tax will be
addressed by each of these subsequent projects individually.

subdivided lots. Lots created by this final map will be subdivided in the
future for residential purposes. Fees and assessments will be paid at the
appropriate time the lots develop.

NOTE 1: Approval of this final map does not confer any rights to build on the subdivided lots. Lots
being created by this subdivision will be subdivided in the future for residential housing
purposes. Impacts on local facilities/utility demands will be assessed at the time of future
subdivision of the lots created by this map.
NOlT2: The dedication of the 24.25 acre park site at the northern terminus of Ambrosia Lane has
satisfied the park requirement for this subdivision.
NOTE3: School facility requirements for this subdivision has been met by the construction of Aviara
Oaks School.

RESOLUTION NO. 92-781
A RESOLUTION OF THE CRY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A FINAL MAP FOR CARLSBAD TRACT 89-37,
AVIARA PHASE II
WHEREAS, Aviara Land Associates Limited Partnership, a has submitted a final
map known as Carlsbad Tract No. 89-37 to the City of Carlsbad for approval; and
WHEREAS, the Tentative Map of Carlsbad Tract No. 89-37 with conditions,
was approved by the Planning Commission on December 19, 1990 pursuant to
Resolution Number 3153; and
WHEREAS, the City Council approved Planning Commission Resolution No. 3153
at its meeting of February 19, 1991 pursuant to Resolution No. 91-80; and
WHEREAS, the City Engineer has determined that said map substantially conforms
to said conditionally approved tentative map; and
WHEREAS, the-conditions of approval for said final map have been completed or
secured; and
WHEREAS, the developer has offered public streets and public easements for
dedication to the City of Carlsbad; and
WHEREAS, the final map conforms to the City of Carlsbad General Plan and all
requirements of City Codes and Standards; and,
WHEREAS, the City Council of the City of Carlsbad determined it to be in the
public interest to approve said Final Map;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That said Final Map known as Carlsbad Tract No. 89-37 from Aviara Land
Associates Limited Partnership which is on file with the City Engineer and is incorporated

herein by reference, is accepted.
3. That the City accepts said dedication.
4. That the City Clerk is authorized to sign the Certificate of Acceptance on
the Final Map.
5. That the City Clerk is authorized to cause the original Final Map to be
recorded in the Office of the County Recorder of San Diego County, State of California.
6. That the City Clerk is authorized to release the map to Stewart Title
Insurance for recording in the office of the County Recorder
