RECOMMENDED ACTION:
Adopt Resolution No. 42 -@p approving a Final Map for Carlsbad Tract No. 90-l 5
Aviara Planning Area 24, Units 1, 2, 3, and 4.
ITEM EXPLANATION:
Engineering staff has completed checking the final maps of Carlsbad Tract 90-15 Units
1, 2, 3 and 4. This subdivision is located at the northeast corner of Alga Road and
Poinsettia Lane. It is comprised of four units with uses as follows: 118 single family
residential lots with five open space lots.
The final map conforms substantially with the Subdivision Map Act, the Carlsbad
Municipal Code and with the conditions of approval and the tentative map as approved
by the City Council on July 16, 1991, per Resolution No. 91-233.
This map has been found to be consistent with the Growth Management Ordinance and
the requirements of the Local Facilities Management Plan for Zone 19. Currently all public
facilities within or impacted by Zone 19 meet or exceed the adopted performance
standard. For a more complete analysis of the public facilities impact for this project, see

The project density is 2.16 du/acres and is below the Growth Management Control Point
of 3.6 du/acre. The findings required to approve the project below the Growth Control
Point were made as a part of the Planning Commission Resolution on 3230 and were
accepted by City Council.
The developer has entered into an agreement with the California Coastal Commission,
creating a deed restriction over the open space areas within the subdivision. This deed
restriction prohibits any encroachment for development into said areas in perpetuity.
The developer has contracted with a licensed environmental consultant to provide
construction observation and monitoring services for the mitigation measures required by
the tentative map and the environmental impact report for the subdivision.
In compliance with the recently updated Housing Element the developer has entered into
an affordable Housing Agreement with the City for the entire Aviara Master Plan. This
agreement was approved by the City Council on September 1, 1992.
The developer entered into a Park Agreement with the City of Carlsbad on June 1,1989.
This Park Agreement provided for dedication of 24.2 acres of land by Aviara for park
purposes in conjunction with Aviara’s Phase I project. This park dedication was in excess
of the park requirements for Phase I so a Park Dedication Credit was established in the
agreement. A Park Credit Accounting Ledger was established as part of the Park
Agreement to monitor the Park Dedication Credit. A updated copy of this ledger is
included as part of the Council agenda package. The 118 residential lots contained in
the four units of CT 90-l 5 create a park dedication requirement of 0.874 acres. The Park
Credit Accounting Ledger has been updated to reflect this quantity.

FISCAL IMPACT:

The exact amount of public facility fees are unknown until the applicant submits an
application for Building Permits. Likewise, the drainage area fees are unknown and will
be assessed at the time the City adopts a drainage fee schedule. Public improvements
for this project include Towhee Lane, Sparrow Road, Vireo Court, Remsen Court,
Nightshade Road, Curlew Terrace, Gull Court and Poinsettia Lane to City Standards and
construction of streets, storm drains and sewer as shown on the improvement plans. No
detailed economic impact analysis of this development has been conducted. While
increased operating expense related to this project are expected to be offset from the
increased tax or fee revenue, no exact percentage of offset can be predicted.
This project is located within Community Facilities District No. 1 (CFD). Upon recordation
of the final map, the CFD will be apportioned to all lots within the subdivision with the
exception of Open Space Lots 25, 61, 87, 88 and 123. Because this is a residential
subdivision, the owner will be required to pay the one time special development tax upon
issuance of each building permit within the project.

RESOLUTION NO. 92-285
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING FINAL MAPS FOR CARLSBAD TRACT 90-15
AVIARA PtANNlNG AREA 24, UNITS 1, 2. 3. AND 4
WHEREAS, Aviara Land Associates Limited Partnership have submitted final maps
known as Carlsbad Tract No. 90-15, Units 1, 2, 3 and 4 to the City of Carlsbad for
approval; and
WHEREAS, the Tentative Map of Carlsbad Tract No. 90-l 5 with conditions,
was approved by the Planning Commission on May 29, 1991 pursuant to Resolution
Number 3230 ; and
WHEREAS, the City Council approved Planning Commission Resolution No. 3236
at its meeting of July 16, 1992 pursuant to Resolution No.90-233; and
WHEREAS, the City Engineer has determined that said maps substantially
conforms to said conditionally approved tentative map; and
WHEREAS, the conditions of approval for said final maps have been completed
or secured; and
WHEREAS, the developer has offered public streets and public easements for
dedication to the City of Carlsbad; and
WHEREAS, the final maps conforms to the City of Carlsbad General Plan and all
requirements of City Codes and Standards; and,
WHEREAS, the Cii Council of the City of Carlsbad determined it to be in the
public interest to approve said Final Maps;
NOW, THEREFORE, BE lT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That said Final Maps known as Carlsbad Tract 90-l 5, Units 1, 2, 3, and 4

from Aviara Land Associates Limited Partnership which are on file with the City Engineer
and are incorporated herein by reference, are accepted.
3. That the City accepts said dedications.
4. That the City Clerk is authorized to sign the Certificate of Acceptance on
the Final Maps.
5. That the City Clerk is authorized to cause the original Final Maps to be
recorded in the Office of the County Recorder of San Diego County, State of California.
6. That the City Clerk is authorized to release the maps to Stewart Title
Insurance for recording in the office of the County Recorder
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 15th day of SEPTEMBER, 1992 by the following vote, to wit:
