PLN SECOMMENDED ACTION: Planning Commission and staff are recommending that the City Council INTRODUCE Ordinance No. Ns-dl/$f I APPROVING SP-19(D). ITEM EXPLANATION The permitted use on all lots within the Car Country Expansion Area is a dealership for the retail sales, leasing, renting and servicing of new and used automobiles and other motor vehicles such as recreational vehicles. The primary activity, however, must be new vehicle sales. Additionally, Lots 2 and 3 are allowed specific retail/auto services. This amendment would allow the remainder of the lots (1,4-10) to include auto rental and leasing, used vehicle sales (even though it is not in conjunction with new car sales), and auto repair as primary activities subject to the following: 1. Approval of a Conditional Use Permit; 2. Irrespective of use, all lot improvements shall be designed and constructed in their entirety so that they can eventually be converted to new motor vehicle dealerships should the need for a new dealership arise: 3. A finding that the use is associated with an existing new auto dealership in Car Country: and 4. A finding that no new auto dealerships are available at the time of approval and, a condition that any time a new car dealership becomes available, the uses identified above shall be abated or modified so that the new auto dealership becomes the primary use of the site. Staff recognizes that in order to make Finding No. 4 above, the City will have to rely on information provided by the applicant regarding the availability of new dealerships and that any condition pertaining to this finding will have to be self- regulated by the applicant. A detailed explanation of the amendment is contained in the attached staff report to the Planning Commission dated May 20, 1992. The Planning Director has determined that the environmental effects of the project have already been considered in conjunction with previously certified environmental documents and, therefore, no additional environmental review will be required and a notice of determination will be filed. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3308, recommending APPROVAL, based on the findings and conditions contained therein. II. PROJECT DESCRIPTION AND BACKGROUND This application requests an amendment to Specific Plan 19(E) to increase the number of permitted uses within the Car Country Expansion Area. The permitted use on all lots within the Car Country Expansion is a motor vehicle dealership for the retail sales, leasing, renting and servicing of new and used automobiles and other motor vehicles such as recreational vehicles but whose primary activity is new vehicle sales. Additionally, a limited number of lots are allowed the following retail/auto services. (Lots 2 and 3) b. Restaurant (subject to approval of a Conditional Use Permit) + .+ C- SP-19(D) - HOEHN GRbJP MAY 20, 1992 PAGE 2 The application which is now before the Commission, (Specific Plan Amendment 19(D)) requests that the following uses be allowed on alJ lots within the Car Country Expansion Area: 1) Auto Rental and Leasing 2) Used motor vehicle sales 3) Auto Repair - Foreign and Domestic. The applicants have indicated that there is no market for new automobile dealerships at this time in this area. Their consultant has indicated that, although they do not envision new franchises that would warrant construction for five to ten years, they are willing to build structures designed to be converted to new automobile dealerships at such time in the future that new dealerships become available. In the interim, these buildings would house the uses listed above (1 - 3). They request the aforementioned uses (1 - 3) be considered appropriate to the specific plan when placed in such convertible structures and associated with existing new car dealerships in Car Country. At the April 1, 1992 Planning Commission meeting staff indicated that all Car Country N automobile dealers had been invited to a meeting to discuss topics of concern, to include this application. At that meeting consensus was achieved on support of the application as long as the the proposed amended uses were affiliated with existing new car dealers in Car Country. The applicants agreed to such a condition and Exhibit “A” reflects same. III. ANALYSIS 1. The proposed amendment is consistent with the existing General Plan land use designation of RRE - Extensive Regional Retail which is established for large, low volume, high cost items such as automobiles. 2. The proposed amendment is consistent with the intent of the existing Specific Plan. The overriding goal is to uphold and surpass the high quality standards of the existing Car Country. This amendment does not affect the development standards that maintain “high quality”, nor does it preclude or dissuade the primary use of the retailing of new and used motor vehicles from the area. DISCUSSION GENERAL PLAN CONSISTENCY The existing General Plan Land Use designation for the Car Country area is RRE - Extensive Regional Retail which is established for large, low volume, high cost items such as automobiles. The uses requested (used vehicle sales, automobile rental and leasing, and automobile repair as accessory and incidental to the automotive dealership design) are consistent with the existing General Plan. .+ - SP-19(D) - HOEHN GRc/JP MAY 20, 1992 PAGE 3 SPECIFIC PIAN CONSISTENCY Page 1 of Specific Plan 19(E) states, “The Car Country Expansion area will continue the land use pattern established in the original auto park...The primary use of the area will be the retailing of new and used motor vehicles.” All lots within the Car Country Expansion presently allow retail sales, leasing, renting, and servicing of new and used automobiles but require the primary activity to be new vehicle sales. The proposed uses are already occurring at the existing Car Country. The overriding goal and purpose of the Specific Plan area is to “uphold and surpass the high quality standards of the existing Car Country” (Specific Plan 19(E), page 1). The standards referred to include the proposed uses as integral to the operation of an automobile dealership. Inherent to such operation and reflective of the high quality standards is an architectural design that portrays the primary activity of new car sales. The amendment includes the condition that the development review process of a site development plan for all of the lots, except 2 and 3, retain the requirement that the project be designed specifically as an automobile dealership. The existing performance standards of Specific Plan 19(E) remain _ intact so that all development is subject to architectural, parking, loading, storage, lighting, noise, odor, vibration, air quality, industrial waste, signage, and landscaping controls. The uses become incidental to the design which upholds ” . ..the high quality standards of the existing Car Country”. At the same time the anomalous development of offsite new automotive dealerships, which was the catalyst for the original expansion (5%19(C)), should be precluded until all of the lots within the expansion area have new car dealerships (with the exception of Lots 2 and 3). The desirability of maintaining the lots for a primary use of new vehicle sales requires that any other use only be permitted by approval of a conditional use permit with a finding that the uses are temporary in nature and new auto dealerships are unavailable. At such time that new car dealerships become available the other uses would either be abated or modified so that the site would primarily accommodate the new car dealership. It should be noted that a secondary intent is to not allow for the expansion of multi-new car dealership on existing new car dealership sites. Our support is conditioned on the assumption that "all lot improvements . ..shall be designed and constructed in their entirety as new motor vehicle dealerships to include both sales and service facilities as a contiguous whole." means that any use will require the user to design and build the entire facility as a complete new car facility including sales and service improvements as a condition of the conditional use permit. Conversely, a user would not be allowed to construct only those improvements specific to their individual use. Bob Baker Chrysler-Plymouth is adamantly opposed to any automotive use that allows the user to circumvent the significant investments of the existing dealers and property owners.
