RES CODE RELATING TO MASSAGE MTG. .9/22/92 TITLE: AMENDMENT TO CARLSBAD MUNICIPAL ESTABLISHMENTS, MASSAGE TECHNICIANS, AND HOLISTIC HEALTH PRACTITIONERS DEPT. CITY A CITY M RECOMMENDED ACTION; 1. Introduce Ordinance No. NS-&?/d amending Carlsbad Municipal Code Chaptc provide for the licensing of Holistic Health Practitioners and allowing them to administer ma businesses or licensed massage establishments. 2. Adopt Resolution No. %-a97 establishing holistic health practitioner license fee. ITEM EXPLANATION: Mr. Paul Schumann, Holistic Health Practitioner (HHP), addressed City Council at their Apr meeting regarding his request for the City to revise its municipal code to allow HHPs to a massage therapy in businesses and homes. Staff has provided Council with additional inforr the matter as requested with recommendations concerning how HHPs might be licer regulated. 1 The Carlsbad Municipal Code allows HHPs or any other qualified person or organization tc license to operate a massage business as long as they meet the requirements in Chapter 5 code (Exhibit 1). Applicants must submit substantial background information to the City inch previous work history and criminal record, if one exists. Applicants must also submit five references testifying to the applicant's moral character and have a complete set of fingerpri by the Police Department. The Police Department verifies information on the applic: investigates the applicant's background. The application is denied if the applicant has been 1. of certain crimes or makes a fraudulent statement on the application. Massage establishments must operate according to stringent regulations. For example equipment must be disinfected each day or after every use and detailed records must be m regarding who has received and administered each massage. Any person wishing to give n in the establishment must first obtain a massage technician's license from the City. In additi application requirements listed above, applicants for this license must also submit proof that 1 graduated from a recognized institution of learning requiring two hundred hours of instrt massage related subjects. Even though a number of states have established requirements for the licensing of HHPs, ( has not done so and is not expected to in the near future. However, a number of local go agencies including the City and County of San Diego, Del Mar, Encinitas, Vista, San Escondido, and Oceanside allow HHPs to give massages in homes and businesses. Orang handles the licensing for many cities in that county and it only allows HHPs to provide therapy in licensed establishments or under the supervision of a chiropractor or medical doc in their office. The City of San Clemente does their own licensing and allows HHPs to give rr in homes or businesses but requires them to report to the Licensing Division each time the) such an offsite visit. The City of San Diego was the only agency which reported having probl the licensing of HHPs because they found that some applicants had been able to purchase tl certificates from a "diploma mill" in the Los Angeles area. L e Page Two of Agenda Bill No. // b 4 0 Staff recommends that HHPs wishing to practice in Carlsbad be required to obtain a license following the same application requirements as massage technicians. In addition, HHPs should be required to provide proof that they have successfully completed one thousand hours of training instead of two hundred as required for massage technicians. The additional educational requirement and a thorough background investigation should prevent the licensing of unqualified applicants. Staff also recommends that HHPs be limited to providing massage therapy in businesses only. HHPs would not be allowed to administer massages in a private residence even if a business was operated in the home. Allowing HHPs to provide massages in homes would cause enforcement problems due to staffing and financial limitations. The proposed ordinance would also prohibit HHPs from providing massage therapy before 7:OO a.m. or after 7:OO p.m. A revision is also proposed which would delete the word “buttocks“ for the section listing what anatomical areas are prohibited from being touched during massages. HHPs have requested the change because it is an area containing important muscles which need to be included in massage therapy for a number of ailments. The California Chapter of the American Massage Therapy Association and a number of local chiropractors have been contacted and they agree that buttocks should not be included as an area that is off-limits for massage. FISCAL IMPACT: Staff anticipates that there will be little fiscal impact if the proposed ordinance is adopted. No estimate is available for what the cost of enforcement efforts might be if HHPs are allowed to provide massages in homes. EXHIBITS: 1. Proposed Revisions to Chapter 5.1 6. 2.
