HomeMy WebLinkAbout1992-10-06; City Council; 11914; Aviara Caladris- OF CARLSBAD - AGE AVIARA PLANNING AREA 16 RECOMMENDED ACTION: Adopt Resolution No. ?a- Joy Aviara Planning Area 16. approving a Final Map for Carlsbad Tract No. 90-l 4 I ITEM EXPLANATION: Engineering staff has completed checking the final map of Carlsbad Tract 90-14. This subdivision is located north of Alga Road between Batiquitos Drive and Black Rail Court. It is comprised of 9 lots with uses as follows: 56 dwelling unit condominiums. The final map conforms substantially with the Subdivision Map Act, the Carlsbad Municipal Code and with the conditions of approval and the tentative map as approved by the City Council on December 4, 1990, per Resolution No. 90-418. This map has been found to be consistent with the Growth Management Ordinance and the requirements of the Local Facilities Management Plan for Zone 19. Currently all public facilities within or impacted by Zone 19 meet or exceed the adopted performance standard. The project density is 4.88 du/acres and is below the Growth Management Control Point of 14.9 du/acre. The findings required to approve the project below the Growth Control Point were made as a part of the Planning Commission Resolution No. 3199 on October 3, 1990, and were accepted by City Council. Lot 7 of this subdivisions is encumbered by an agreement with the California Coastal Commission, creating a deed restriction over said Lot. This deed restriction prohibits any encroachment for development into said area in perpetuity. The dedication of a 24.25 acre park site at the northern terminus of Ambrosia Lane in conjunction with Aviara Phase I, Unit C project satisfies park fees requirements of this subdivision. An updated Park Credit Accounting Ledger, monitoring the Park Dedication Credits of the projects within Aviara is included as a part of the Council agenda package. FISCAL IMPACT: This project will generate the following fees at building permit issuance: 1. Traffic Impact Fees (56 units @ $328/unit) $ 18,368 2. Sewer Connection Fees(56 units @ $1,61 O/unit) $ 90,160 3. Water Service Connection Fee(56 units @ 2,20O/unit) $123,200 4. Community Facilities District No. 1 Fees (56 units @ 2,81 O/unit) $157,360 The exact amount of public facility fees are unknown until the applicant submits an application for Building Permits. Likewise, the drainage area fees are unknown and will be assessed at the time the City adopts a drainage fee schedule. Public improvements for this project include improvements within Alga Road to City standard. The street improvements within this subdivision are private which will be privately maintained. While increased operating expense related to this project are expected to be offset from the increased tax or fee revenue, no exact percentage of offset can be predicted. This project is located within Community Facilities District No. 1 (CFD). Upon recordation of the final map, the CFD will be apportioned to all lots within the subdivision with the exception of Open Space Lot 7 and the recreational Lots 6, 8, and 9. (Because this is a residential subdivision, the owner will be required to pay the one time special development tax upon issuance of each building permit within the project.)
