RECOMMENDED ACTION:
Adopt Ordinance No. NS-214, approving Specific Plan Amendment SP-19(D), the Car
Country Expansion Area.
J.TEM EXPLANATION
Ordinance No. NS-214 was introduced and first read following a public hearing at the
regular Council meeting held on September 22, 1992. The second reading allows
Council to adopt the ordinance which would then become effective in thirty days. The
City Clerk will have the ordinance published in the “Carlsbad Journa!’ within fifteen
days, if adopted.

ORDINANCE NO. NS-214
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING SPECIFIC PLAN AMENDMENT SP-19(D), THE CAR COUNTRY EXPANSION AREA.
The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION I: That Section III A. 1. of Specific Plan 19(E) is
amended by the addition of the following:

” PI Subject to the approval of a Conditional Use Permit with., the finding that the use is associated with an existing new auto dealership in Car Country, a finding that no new auto dealerships are available at the time of approval and, a condition that any time a new car dealership becomes available, the following uses shall be abated and/or modified so that the new auto dealership becomes the primary use of the site.

SECTION II: That Section III D of Specific Plan 19(E) is
amended to include the following:
*'Irrespective of use, all lot improvements, with the exception of Lots 2 and 3, shall be designed and constructed in their entirety as new motor vehicle dealerships to include both sales and service facilities as a contiguous whole."
EFFECTIVE DATE: This ordinance shall be ef-fective thirty days
after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to b*e published at least
once in. the Carlsbad Journal within fifteen days after its
adoption. .
