ITEM EXPLANATION: On May 22, 1990, the City Council held a public hearing and adopted Resolution No. 90-151 designating State Street from Beech Avenue to Carlsbad Boulevard and Laguna Drive from State Street to Jefferson Street as Underground Utility District No. 12, in accordance with Chapter 11.08 of the Municipal Code. All owners were sent a notice of the formation of the underground district. The Municipal Code also says that the Council shall fix by subsequent resolution the time by which owners must be ready to connect to the underground system. The San Diego Gas & Electric Company and the other utility companies are responsible for all construction work for this project. They have designed and will construct the project. Work began on October 5, 1992 and SDG&E estimates that trenching work will be completed on November 30, 1992. Pole removal depends on Pacific Bell's readiness, but is estimated to be May 1, 1993. SDG&E also estimates that customers should be ready to connect to the underground system by December 31, 1992. All property owners and residents have already received notice of this date from SDG&E. It is the responsibility of each owner to hire a contractor and install underground service to their residences at their own expense. Immediately following Council's adoption of the resolution setting the time to connect, notices will be sent by the City to all property owners and residents. FISCAL IMPACT: The entire cost of the undergrounding will be paid by San Diego Gas & Electric Company, Pacific Bell, and Daniels Cablevision, under Rule 20A of the Public Utility Commission. Each property owner will be responsible for undergrounding their own service at a cost of $1,100 to $1,500 per service. ae 1. Location map. < 2. These utilities include electric, telephone and cable television. The hiring of a contractor, obtaining a permit and paying the cost of connection to private property is the responsibility of the property owner. This district, which includes property for which you are listed as owner, contains portions of State Street and Laguna Drive. A boundary map is attached. The City Code requires that you be notified by sending you a copy of the approved Resolution and a copy of the pertinent City Code, both of which are attached. In summary, the pertinent facts are: 1. 2. The district has been formed and utility agencies have been notified to begin design work. The schedule is currently not certain but design work and right-of-way acquisition must be completed before construction can begin. The best estimate at this time is that construction may begin in August 1991. It is the property owner’s responsibility to provide the appropriate underground services from the street right-of-way to the building at the owner’s expense. Please note that once design is completed, Council must pass another resolution specifylng a date of connection and you will be notified again prior to start of construction of the actual time to connect to the underground svstem. 3. 4. . If after the public hearing the city council detennines that the city or a public utility has agreed to pay over fifty percent of all costs of conversion, excluding costs of users’ connections to underground electric or communication facil- ities and that the public health, safety and welfare requiressuch removal and underground installa- tion, the city council. may by resolution declare the area an underground utility district and order the work. Such resolution shall include a descrip- tion of the area comprising such district and shall provide that the council shall fix by subsequent resolution, the time within which such removal and underground installation shall be accorn- plisheQ having due regard for the availability of labor, materials and equipment necessary for such removal and for the installation of such utility districts by resolution. 11.08.010 Definitions. Whenever in this chapter the words or phrases hereinafter in this section defined are used, they shall have the respective meanings assigned to them in the following definitions: (1) “Commission” means the Public Utilities Commission of the state of California; (2) “Poles, overhead wires and associated overhead structures” mean poles, towers, sup- ports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers, insulators, cut- outs, switches, communication circuits, appliances, attachments and appurtenances located aboveground within a district and used or usefbl in supplying electric, communication or similar or associated service; (3) “Underground utility district” or “dis- trict” means that area in the city withm which poles, overhead wires, and associated overhead structures are prohibited as such area is described in a resolution adopted pursuant to the provi- sions of Section 11.08.030; 327 11.08.030 w w underground facilities as may be occasioned thereby. (1) Any municipal facilities or equipment installed under the supervision and to the satis- faction of the city engineer, (2) Poles, or electroliers used exclusively for street lighting; (3) Poles, overhead wires and associated over- t~c energy at nominal voltages in exceSS of thirty- four thousand five hundred volts; (4) Antennae, associated equipment and sup porting Structures, used by a utdty for furnishng communication senices; (5) Equipment appurtenant to underground facilities, such as sudace mounted transfomers, inets, and conceded ducts; (6) Temporary poles. overhead wires and associated overhead structures used or to be used (7) Overhead wires (exclusive of supporting structures) crossing any ponion of a district ited, or connecting to buildings on the pefimeter from which poles. overhead wires and associated overhead stxuctures are not prohibited; (8) Overhead wires attached to the exterior surface of a building by means of a bracket or other fixture and extending from one location on the building to another location on the same building or to an adjacent building without cross- ing any public street. (9) New or existing anchor poles and guy wires within the district necessary to support overhead facilities outside the district. Whenever the council creates an underground overhead wires and associated overhead struc- tures therein as provided in Section 11.08.030, it is unlawful for any person or utility to erect, construct, place, keep, maintain, continue, employ or operate poles, overhead wires and associated overhead stmctures in the district after the date when the overhead facilities are except as the overhead facilities may be required to furnish service to an owner or occupant of propem prior to the performance by such Owner for such owner oir occupant to continue to receive utility service as provided in Section to remove said facilities after said work has been this chapter. (Ord. 7037 fj 4, 1968) 1 1.08.050 Exception-Emergency or unusual Notwithstanding the provisions of this chap- ter, overhead facilities may be installed and maintained for a period, not to exceed thirty days, without authority of the council in order to provide emergency service. The council may grant special permission, on such terms as the council may deem appropriate, in cases of unusuai circumstances, without discrimination as to any person cr utility, to erect, construct, install, maintain, use or operate poles, overhead wires and associate? overhead structures. Notification by the city clerk shall be made by mailing a copy of the resolution adopted pur- suant to Section 11.08.030, together with a copy of the ordinance codified in this chapter to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. (Ord. 7037 § 7, 1968) 11.08.080 Responsibility of utility companies. does not comply with the provisions of sub- paragraph (a) of this section within the time pro- vided for in the resolution enacted pursuant to Section 11.08.030, the city engineer shall post written notice on the property being served and thirty days thereafter shall have the authonty to order the disconnection and removal of any and all overhead service wires and associated fad- ties supplying utility service to said property. (c) In addition to the provisions of sub- paragraph (b) above, upon direction by the city council, the engineer shall give notice in wnting to the person in possession of such premises. and a notice in writing to the owner thereof as shown on the last equalized assessment roll, to provide the required underground facilities within ten days after receipt of such notice. (d) The notice to provide the required under- ground facilities may be given either by personal service or by mail. In case of service by mail on either of such persons, the notice must be depos- ited in the United States mail in a sealed envelope with postage prepaid, addressed to the person in possession of such premises at such premises, and the notice must be addressed to the owner be addressed to such owner’s last known address as the same appears on the last equalized assess- ment roil, and when no address appears. to b6Gened Defivery, city of Carlsbad.” If notice is given by mail, such notice shall be deemed to have been received by the person to whom it has been sent within fortyeight hours after the mad- ing thereof. If notice is given by mail to either the owner or occupant of such premises, the city engineer shall, within fortyeight hours after the mailing thereof, cause a copy thereof, printed on a card not less than eight inches by ten inches in size, to be posted in a conspicuous place on the premises. (e) The notice given by the city engineer to provide the required underground facilities shall particulariy specifj what work is required to be done. and shall state that if the work is not com- pleted within thirty days after receipt of such If underground construction is necessary to provide utility service within a district created by any resolution adopted pursuant to Section portion of the conduits, conductors and associ- ated equipment required to be furnished by it under its applicable rules, regulations and tariffs on file with the commission. (Ord. 7037 9 8, 1968) 11.08.090 Responsibility of property owners. (a) Every person owning, operating, leasing, occupying or renting a building or structure within a district shall construct and provide that portion of the service connection on his property between the facilities referred to in Section 11.08.080 and the termination facility on or within said building or structure being served, all in accordance with applicable rules, regulations and tariffs of the respemve utility or utilities on file with the commission. (b) In the event any person owning, operat- ing, leasing, occupying or renting said property 11.08.030. the Supplying Utility shall furnish that thereofas such owner7s name appean, and musf 3 29 11.08.090 w e notice, the city engineer will provide such required undewound facilities, in which case the cost and exipense thereof will be assessed against the property benefited and become a lien upon such property. (f) If upon the expiration of the thirty day period, the required underground facilities have not been provided, the city engineer shall forth- with proceed to do the work; provided, however, if sucfi premises = unoccupied and no electfic or communications =.,,ices are being furnished thereto, the city engineer shall in lieu of provid- ing the required underground facilities, have the authority to order the disconnection and removal of any and ail overhead service wires and associated facilities supplying utility service to the property. Upon completion of the work by the city engineer, he shall file a written report with the city council setting forth the fact that the required underground facilities have been pro- vided and the cost thereof, together with a legal description of the property against which such cost is to be assessed. The council shall thereupon fix a time and plaice for hearing protests against the =sment of the cost of such work upon such premises, which said time shall not be less than ten days thereafter. (g) The city engineer shall forthwith, upon the time for hearing such protests having been fixed, give a notice in writing to the person in posses- sion of such Prernim, and a notice in writing thereof to the owner thereof, in the manner here- inabove Provided for the giving ofthe notice to provide the required underground facilities. of the time and place that the council wiil pass upon such report and will hear protests against such assessment. Such notice shall also set forth the amount of the proposed assessment. (h) Upon the date and hour set for the hearing of protests, the council shall hear and consider the report and all protests, if there be any. and then proceed to affirm, modify or reject the assessment. (i> If any assessment is not paid within five days after its confirmation by the cound, the ~~Ount of the assessment shall become a lien upon the Property against which the assessment is made by the city engineer. and the city engineer is directed to turn Over to the assessor and tax collector a notice of lien on each of the properties on which the assessment has not been paid, and the assessor and tax collector shall add the amount of the assessment to the next regular bill for taxes levied against the premises upon which said assessment was not paid. The assess- rnent shall be due and payable at the same time as the property taxes are due and payable. and if not paid when due and payable,shall bear interest at the rate of six percent per year. The city shall remove at its own expense all City-Owned equipment from all Poles required to be removed under this chapter in ample time to enable the Owner Or user Of SUCh pOkS to remove the Same within the time specified in the reSOlU- tion enacted pursuant to Secton 11.08.030. (Ord. 7037 5 10, 1968) 11.08.1 10 Extension of time. In the event that any act required by this chap ter or by a resolution adopted pursuant to Section 11.08.030 cannot be performed withn the time provided on account of shortage of materials, war. restraint by public authorities, strikes, labor disturbances, civil disobedience, or any other circumstances beyond the control of the actor, then the time within which such act will be accomplished shall be extended for a period equivalent to the time of such limitation.
