RECOMMENDED ACTION:
Adopt Resolution No. 72 -335 appropriating funds from the Police Asset Forfeitu
the support of police activities.
ITEM EXPLANATION:
The City of Carlsbad receives disbursed funds as a result of the Police Department'
enforcement efforts and participation in the United States Government and State o
asset forfeiture programs. These funds are restricted by statute for use by
Department only and must be used to increase and not supplant law enforcement rc
the Police Department.
The recommended action will appropriate $30,000 from the Police Asset Forfc
(federal) making it available to the Police Department for expenditures. Once ap
these funds will be controlled by the same rules which apply to other City funds.
The City currently has an unappropriated balance of $1,200,000 in the Police Asse
Fund. The appropriation of $30,000 will leave a balance of $1,170,000.
The recommended action will expand the scope of the special Warrant/Entry Overtir
approved by Council in the FY 91-92 budget by providing overtime for special
including assisting allied agencies in narcotic and other investigations.
Special operations with other agencies occasionally result in the seizure of proper
later shared with Carlsbad. In addition, Carlsbad is occasionally reimbursed for co:
during special operations. By establishing a special operations account, a
reimbursed to Carlsbad would be deposited into this account to assure that forfeitel
not mingled with general funds. By creating and funding the Special Operation
Account, monies seized and reimbursed will provide the funding for these special OF

RESOLUTION NO. 92-335
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROPRIATING FUNDS FROM
THE POLICE ASSET FORFEITURE FUND (FEDEML) FOR
THE SUPPORT OF POLICE ACTIVITIES
WHEREAS, from time to time, the City of Carlsbad Police Department receives
funds and assets resulting from the Police Department's drug enforcement activities; and
WHEREAS, said funds should be utilized for law enforcement purposes and
supporting police activities; and
WHEREAS, the appropriation of said funds is necessary before any expenditure of
funds can take place: and
WHEREAS, the Police Forfeiture Asset Fund has an available fund balance of
$1,200,000.
NOW, THEREFORE, BE IT RESOLVED by the C'v Council of the City of Carlsbad,
California, that the amount of $30,000 hereby be appropriated from the available fund
balance of the Police Asset Forfeiture Fund (Federal) to support Special Operations of
the Investigations Division.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 17th day of November, 1992, by the following vote to wit:
