Adopt Resolution No. 9d-3/to approving a Final Map for Carlsbad Tract No. 90-01, Yazdi
Condominiums AKA Chestnut Green Townhomes, PUD 90-01, SDP 90-02.

ITEM EXPLANATION:
Engineering staff has completed checking the final map of Carlsbad Tract 90-01. This subdivision
is located in the north beach area which is west of Interstate-5 between Buena Vista and Aqua
Hedionda Lagoons. The property fronts on Chestnut Avenue and is between Garfield Street and
the AT&SF Railroad right-of-way. It is comprised of one parcel with uses as follows: six unit
residential condominium planned unit development.
The final map conforms substantially with the Subdivision Map Act, the Carlsbad Municipal Code,
the conditions of approval, and the tentative map as approved by the Planning Commission on
December 5, 1990, per Resolution No. 3165.
This map has been found to be consistent with the Growth Management Ordinance and the
requirements of the Local Facilities Management Plan for Zone 1, Currently all public facilities
within or impacted by Zone 1 meet or exceed the adopted performance standard. For a more
complete analysis of the public facilities impact for this project, see the attached Local Facilities
Impact Assessment Form.
The project density is 11.76 du/acre and is below the Growth Management Control Point of 19
du/acre. The findings required to approve the project below the Growth Control Point were made
as a part of the Planning Commission Resolution on December 5, 1990 per Resolution No. 3165.
This project is consistent with the General Plan, RH Zone and the Beach Overlay Zone. It also
meets all the requirements of the Zoning Ordinance, Planned Development Ordinance and
complies with Growth Management. The developer has secured the required improvements in
a form acceptable to the City. Staff recommend acceptance of the final map for CT 90-01.
FISCAL IMPACT:
This project will generate the following fees at building permit issuance:
1. Park-in-lieu Fees (6 units @ 1170/unit)
2. Traffic Impact Fees(6 units @ 616/unit)
3. Sewer Permit (6 units @ 1,61 O/unit)
4. Water Service Connection Fee(6 units @ 2,20O/unit)

The exact amount of public facility fees are unknown until the applicant submits an application
for Building Permits. Likewise, the drainage area fees are unknown and will be assessed at the
time the City adopts a drainage fee schedule. Public improvements for this project include street
paving, curb, gutter, sidewalk, drainage facilities, sewer facilities and water services to City
Standards as shown on the improvement plans. No detailed economic impact analysis of this
development has been conducted. While increased operating expense related to this project are
expected to be offset from the increased tax or fee revenue, no exact percentage of offset can
be predicted.

RESOLUTION NO. 92-340
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A FINAL MAP FOR CARLSBAD TRACT 90-01,
YAZDI CONDOMINIUMS AKA CHESTNUT GREEN TOWNHOMES, PUD
90-01, SDP 90-02
WHEREAS, lraj Yazdi, Daryoush Yasha, Bernard Rosenthal, Irene Rosenthal, Mehdi
Mossazadeh and Shahnaz Mossazadeh, have submitted a final map known as Carlsbad
Tract No. 90-01 to the City of Carlsbad for approval; and
WHEREAS, the Tentative Map of Carlsbad Tract No. 90-01 with conditions, was
approved by the Planning Commission on December 5, 1990 pursuant to Resolution
Number 3165; and
WHEREAS, the City Engineer has determined that said map substantially conforms
to said conditionally approved tentative map; and
WHEREAS, the conditions of approval for said final map have been completed or
secured; and
WHEREAS, the developer has offered public easements for dedication to the City
of Carlsbad; and
WHEREAS, the final map conforms to the City of Carlsbad General Plan and all
requirements of City Codes and Standards; and,
WHEREAS, the City Council of the City of Carlsbad determined it to be in the
public interest to approve said Final Map;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That said Final Map known as Carlsbad Tract 90-01 from lraj Yazdi,
Daryoush Yasha, Bernard Rosenthal, Irene Rosenthal, Mehdi Mossazadeh and Shahnaz
Mossazadeh which is on file with the City Engineer and is incorporated herein by
reference, is accepted.
3. That the City accepts said dedication.
4. That the City Clerk is authorized to sign the Certificate of Acceptance on
the Final Map.
5. That the City Clerk is authorized to cause the original Final Map to be
recorded in the Office of the County Recorder of San Diego County, State of California.
6. That the City Clerk is authorized to release the map to Fidelity National Title
Insurance Company for recording in the office of the County Recorder
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
NOVEMBER
Council held on the 17th day of / , 1992 by the following vote, to wit:
