By minute motion, direct staff to proceed with the district, hire an assessment
engineer upon receipt of sufficient funds, and defer staff administration and
planchecking charges until after the sale of bonds.
ITEM EXPLANATION:
La Costa Downs is an existing, unimproved 40-lot subdivision located east of
Carlsbad Boulevard just north of the Lanikai Mobile Home Park. Because the lot
sizes and street right-of-way widths are substandard, a Specific Plan was developed
and adopted by the City Council on June 25, 1991. Three local streets must be
improved: Ponto Drive, Franciscan Road, and Descanso Boulevard. Ponto Drive is
partially improved now and serves as access to the Lanikai Mobile Home Park.
The 40 lots are owned by approximately 15 property owners. The owners have
expressed interest in forming an assessment district as this is the only practical
way that the roads can be put in so that the lots may be developed. The owners
have submitted petitions representing 65% of the lots within the subdivision (26
lots out of 40). Eleven of the lots are owned by the Santa Fe Railway and will
soon come under the ownership of the North County Transit District.
The first step in forming an assessment district would be to hire an assessment
engineer and a bond counsel. Both would be selected and hired by the City. The
property owners have a registered engineer who will perform the design engineering
and defer his fee until after the bond sale.
Staff estimates the cost of a consulting assessment engineer will be $20,000.
Prior to staff hiring an assessment engineer, the property owners will be required
to deposit $20,000 with the City to cover the cost.
The property owners requested and staff recommends that City staff costs for
administration and planchecking be deferred until after the bond sale. This will
reduce the amount of up-front deposit from the property owners.
In their staff report for the La Costa Downs Specific Plan, the Planning Department
encouraged the owners to pursue an assessment district. This seems to be the only
practical way to install the needed public improvements. Up to now, individual lot
owners have been unable to develop due to the expense of needed public
improvements.
The private engineer is already working on the design of the streets and other
public improvements which will go through the standard plancheck process.
FISCAL IMPACT:
All costs for the assessment district will be paid for by the affected property
owners. The property owners will deposit $20,000 for an assessment engineer.
Staff administration and planchecking charges will be deferred until the sale of
bonds. All other costs will not be due until after the sale of bonds and will be
paid from bond proceeds.

The property owners will make semi-annual payments for interest and principal on
the bonds until they are paid off (typically 10 to 20 years).
