Adopt Resolution No. 53 -/ approving the above ground encroachment reque!

ITEM EXPLANATION:
Ms. June Andersen has requested an above ground encroachment permit to allou
existing 6 foot high wood fence around her side and front yards. The fence was
several years ago and stands 7.5 feet from the face of curb, 2.5 feet outside the pror
line. The 20 foot setback requirement is met in the front yard where the fence enclc
the rear yard and meets the house. Staff has inspected the site and has determined
the encroachment will not adversely affect the public's ability to use the easement.

A RESOLUTION TO THE CITY COUNCIL OF THE CITY OF CARLSBAD
CALIFORNIA APPROVING THE ABOVE GROUND ENCROACHMENT FOR 3350
VALLEY STREET.
WHEREAS, Ms. June Y. Andersen has submitted a request to allow an existins
fence to remain in the public right of way along her property at 3350 Valley Street; ar
WHEREAS, the fence is fronting property described by San Diego as Cour
Assessor as Parcel Number 205-080-36; and
WHEREAS, the City Engineer has determined the encroachment will not adverse
the public’s ability to use the easement; and
WHEREAS, the owner requesting the encroachment has executed an Encroa
Agreement wherein she covenants and agrees with the City of Carlsbad as follows:

ENCROACHMENT AGREEMENT
FOR USE WITH STRUCTURES BUILT OVER PUBLIC RIGHT OF WA
This ENCROACHMENT AGREEMENT ( llAgreementll) is entere between the CITY OF CARLSBAD (lrCityll) and Ms. June Y. Ani (flOwnerll), in accordance with Chapter 11.16 of the C(
Municipal Code.
1. The Propertv. Owner i the owner of that certa property located at 3350 Valley Street, within the C Carlsbad, San Diego County, California, Assessorls Parcel
205-080-36, and more particularly described in Exhibi
attached hereto and incorporated herein by reference.
2. The Easement. City cu ntly owns an existing e over, under, and across Ownerls property for street and utility purposes which easement is described in Exhil

3. The Encroachment. City hereby covenants and agr grants its permission to Owner to maintain an existing fence within the public right of way. A plat showing the 1

other time as specified in the notice after receipt of it from the City Engineer, or the
City Engineer may cause such work to be done

constitute a lien upon the property.
