RECOMMENDED ACTION:
Adopt Resolution No. ‘? 3 * L\ accepting a bid and awarding a con tra ct for
maintenance of the Buena Vista Channel, U/M Contract No. 92-S.
Item Emlanation: ~
On August 18, 1992, the City Council adopted Resolution No. 92-260 authori g the z/n
advertisement of bids for maintenance of the Buena Vista Channel. Two sealed bids
were received on December 17, 1992 as follows:
Rutledge Gradalls $205,733
Whillock Contracting $361,799
This maintenance contract work consists of a partial clearing of silt, vegetati n and b other debris from that portion of the channel between the Haymar Street Bridge and
the Jefferson Street bridge. This will restore the intended drainage pattern and prevent
flooding of adjacent properties.
This maintenance project is expected to begin in late January, 1993 and be completed
during the month of February. The engineer’s cost estimate for the project is $130,000.
Staff from the Utilities and Maintenance Department, Purchasing Department and the
City Attorney’s Office have reviewed the completed bid documents from all parties and
have concluded that the lowest responsive, responsible bidder is Rutledge Gradalls. It
is therefore recommended that the award of the contract be made to Rutledge Gradalls.
Environmental Review I
An environmental impact assessment was completed for this project and N tice of 0
Exemption was filed August 19, 1992, by the Planning Director with the State Office
of Planning and Research. No public comments were received and a Notice of
Exemption was granted under the California Environmental Quality Act, Section 15301
B pertaining to the operation, repair, maintenance and/or repair of existing public or
private structures or facilities, involving negligible or no expansion of use beyond that
previously existing.
Additional review was required by both federal and state agencies, because th Buena e!
Vista Creek Channel supports wetland habitats and is also a tributary to a larger
navigable body of water. Utilities and Maintenance Department staff has applied for
and successfully obtained the following permits:

U.S. Army Corps of Engineers Pre-Discharge Notification
U.S. Fish and Wildlife Pre-Discharge Notification
California Department of Fish and Game, 1601 Permit
California Regional Water Quality Control Board, 401 Certification
California Coastal Commission, Coastal Development Permit
Conditions associated with these permits have been incorporated into this contract and
will be observed by the contractor as needed for completion of this work.
Fiscal Impact
All costs for the project, including staff time, are paid directly from the Buena Vista
Maintenance District fund, a special benefit assessment district which was formed in
Fiscal Year 1989-90 according to the provisions of the “Benefit Assessment Act of 1982”
(Government Code Sections 54703-54718). There will be no fiscal impact to the City’s
general fund.

A RESOLUTION OF THE m COUNCIL OF THE CXIY
OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND
AUTHORIZING THE EXECUTION OF CONTRACT NO.
U/M 92-5 FOR THE MAINTENANCE OF THE BUENA
VISTA CHANNEL.
WHEREAS, bids have been received by the City of Carlsbad, California for the
maintenance of the Buena Vista Channel in accordance with Contract No.
U/M 92-5; and
WHEREAS, the lowest responsive bid received for these services was
submitted by Rutledge Gradalls of Jamul, California with a total amount of
$205,733; and
WHEREAS, funds are available in account number 162-820-5910-2489 for
this work.
NOW, THEREFORE, BE IT RESOLVED by the City council of the City of
Carlsbad, California, as follows:

The above recitations are true and correct.
The bid of $205,733 by Rutledge Gradalls of Jamul, California, for the
maintenance of the Buena Vista Channel, Contract No. U/M 92-5, is
hereby accepted and the Mayor and City Clerk are hereby authorized
to execute an agreement therefore.
