ECOMMENDED ACTION:
If Council concurs, ADOPT City Council Resolution No. 9 3 - Y , granting a waiver from the
prohibitions contained in Urgency Ordinance No. NS-206 to allow construction of an accessory
structure in the required rear and side yard setback at 3220 McKinley Street, in the R-1 Zone.
ITEM EXPLANATION
At its meeting of July 14, 1992, the City Council adopted Ordinance NS-206, extending Urgency
Ordinance No. NS-203, which prohibits the issuance of building permits for accessory structures within
required side and rear yard setbacks in the R-1 single family residential zone. The Urgency Ordinance
will remain in effect until a zone code amendment to regulate accessory structures has been considered
or for 10 months and 15 days from the date of adoption, whichever occurs first. Included in the action
is a provision whereby after notice and public hearing, the City Council can waive the prohibitions of
the ordinance upon findings by Council that the issuance of a building pennit for an accessory structure
in a required setback does not threaten public health or safety.
The proposed accessory structure is a one story, 455 square foot garage, located in the rear and side
yard setback, three feet from the side and rear property lines. The R-1 ordinance allows for the
placement of accessory buildings within side and rear yard setbacks provided they are non-dwelling
buildings. Chapter 21.04.150 of the Carlsbad Municipal Code defines a garage as a non-dwelling
building, and Chapter 21.110.100(1) requires each single family residence to provide a garage having
a minimum dimension of 20 feet. The existing residential structure does not include a garage and is,
therefore, nonconforming. Since the applicant is attempting to remodel and add square footage to the
existing nonconforming residence, he must bring the property into conformance by constructing a
garage either attached to the residential structure or as an accessory structure.
In compliance with the City Council's desire for public notice of these proposals, all property owners
within a 300 foot radius of the subject property have been notified by the City of said request to
construct an accessory building in the rear and side yard setback of the applicant's property.
The proposed garage complies with the garage and accessory structure requirements specified by
Chapters 21.110.100(1) and 21.10.050(1)(D) of the Zoning Ordinance and construction of the
garage will not be constructed over any recorded utility easement or interfere with utility or emergency

PROHIBITIONS CONTAINED IN CITY COUNCIL URGENCY
WHEREAS, a verified application has been filed with the
City of Carlsbad for a waiver from the prohibitions contained in
City Council Urgency Ordinance No. NS-206 for an accessory
building located at the rear and side yard setback at 3220
McKinley Street in the R-1 Zone; and
WHEREAS, such a waiver is permitted under Section IV of
City Council Urgency Ordinance No, NS-206 after notice and public
hearing upon findings by the City Council that the continued
construction or issuance of permits for such structures do not
represent a threat to public health or safety; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City
Council of the City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That based on the evidence presented at the public
hearing, the City Council APPROVES Accessory Structure - 02, based
on the following findings and subject to the following conditions:

1. Approval is granted for Accessory Structure - 02, as shown on Exhibits I1A1l - @*GI1, dated December 3, 1992, incorporated by reference and on file in the Planning Department. Development
shall occur substantially as shown unless otherwise noted in these
conditions. If desired, alterations to the exhibits may occur after the effective date of the ordinance to be created by Zone Code Amendment 92-7 addressing regulations for accessory structures in the side and rear yard, provided that such alterations conform to the standards, procedures, and provisions of such ordinance. Prior to the effective date of such ordinance, any substantial changestothe exhibits will require approval from the City Council.
