SPECIAL ELECTIONS TO BE HELD MORE THAN

ITEM EXPLANATION
The Government Code has been amended to delete a provision
which prohibited special elections from being held more than
270 days from the call of the special election. The proposed
amendment to C.M.C. section 2.04.030 will conform with the
change in state law. (Gov. Code, f; 36512(c)(3).)
FISCAL IMPACT
This ordinance will allow the City Council to set a special
election on the day of the statewide general election, even if the date is more than 270 days from the call of the special
election. This will avoid the cost of a separate election
which is $3 per registered voter, or $125,000 for the number
of voters registered to date. This should be compared with a
cost of 30 cents per voter for elections which are combined
m with a statewide election.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIAf AMENDING TITLE 2,
CHAPTER 2.04 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 2.04.030 TO ALLOW SPECIAL ELECTIONS TO BE HELD MORE THAN
270 DAYS FROM THE CALL OF THE ELECTION
The City Council of the City of Carlsbad, Californi
does ordain as follows:
SECTION 1: That Title 2, Chapter 2.04 of the Carlsk
Municipal Code is amended by the amendment of section 2.04.C
to read as follows:
"2.04.030 Vacancies - Special election to fill aft
a term of temporary appointee. This section is adopted pursuz to the authority of California Government Code sectj 36512(c)(3). A person appointed to fill a vacancy on the Cj Council shall hold office only until the date of a specj
election which shall immediately be called to fill the remainc of the term. Such special election may be held on the date the next regularly established election or the next regular
scheduled election to be held throughout the city but not 1c
than 90 days from the call of the special election."
EFFECTIVE DATE: This ordinance shall be effect:
