RECOMMENDED ACTION:
Adopt Resolution No. 9f0A 0 approving the above ground encroachment request to r
an existing 37" split rail fence in the right of way at the southwest corner of Tamarack
and Chatham Drive.
ITEM EXPLANATION
The Villas of Calavera Hills Homeowners Association has requested an above
encroachment permit to allow an existing 37 inch high split rail fence in the right of wa
corner of Tamarack Avenue and Chatham Drive. The fence was constructed several yc
to keep pedestrians off the 2:l slopes along the sidewalk and to protect the landscap
irrigation. The fence serves as a safety precaution, is aesthetically pleasing and d
adversely affect the public's ability to use the easement. The utility companies were noti
they have no objections to this encroachment. As a standard requirement of an encroi
request the applicant has signed an Encroachment Agreement.

RESOLUTION NO. 93-20
A RESOLUTION OF THE CITY COUNCIL OF CARLSBAD
CALIFORNIA APPROVING THE ABOVE GROUND
ENCROACHMENT AT THE SOUTHWEST CORNER OF
TAMARACK AVENUE AND CHATHAM DRIVE.
WHEREAS, The Villas of Calavera Hills Homeowners Association has subm
request to allow an existing 37 inch split rail fence in the public right of way; and
WHEREAS, the fence is fronting property described by San Diego County Tax A:
as Parcel Number 167-480-1 7; and
WHEREAS, the City Engineer has determined the encroachment will not adverse1
the public’s ability to use the easement; and
WHEREAS, the homeowners association requesting the encroachment have e>
an Encroachment Agreement wherein they covenant and agree with the City of Carla
follows:
1. That the above described structure shall be installed and maintained ii

ENCROACHMENT AGREEMENT FOR USE WITH STRUCTURES BUILT OVER PUBLIC RIGHT OF WA
This ENCROACHMENT AGREEMENT ( lfAgreementll) is entere
between the CITY OF CARLSBAD (IICitytl) and The Villas of C;
Homeowners Association, ( tlOwnerll) , in accordance with Chapte of the Carlsbad Municipal Code.
1. The Propertv. Owner is the owner of that certaj property located at the southwest corner of Tamarack Aver
Chatham Drive, within the City of Carlsbad, San Diego (
California, Assessor's Parcel Number 167-480-17, and
particularly described in Exhibit 'IA'I, attached here1
incorporated herein by reference.
2. The Easement. City currently owns an existing er
over, under, and across Ownerls property for street purpose:

3. The Encroachment. Ci hereby covenants and
grants its permission to Owner to maintain a 37" split rail

(A) The encr installed and maintained in a safe and sanitary condition at the sole cost, risk, and responsibility of the owner and its successors in interest.
(B) The Owner shall agree at all times to
indemnify and hold the City free and harmless from any and all claims, demands, losses, damages, or expenses resulting from the
construction, maintenance, use, repair or removal of the structure installed hereunder, including any loss, damage, or expense arising out of (1) loss or damages to property and (2) injury to or death of persons.
The Owner must remove or relocate any part of
the encroachment within ten (10) days or such
other time as specified in the notice after receipt of it from the City Engineer, or the City Engineer may cause such work to be done
and the reasonable cost thereof shall

constitute a lien upon the property.
