RECOMb$NDED ACTION:
Adopt Resolution No. sq-2-l accepting an irrevocable offer of dedical streets and highway purposes and directing the City Clerk to cause said act to be recorded in the Office of the County Recorder.
ITEM EXPLANATION:
As a condition of approval of a Certificate of Compliance for the property at 570 Laguna Drive, the property owners, Dr. and Mrs. Thomas H. Haye required to make an offer of dedication for streets and highway purpos ten-foot strip of land along their frontage on the north side of Laguna Dr irrevocable offer of dedication for streets and highway purposes was n recorded on May 27, 1975. At the same time, the City determined t construction of any improvements should be postponed. The property owner a contract for Future Public Improvements. The irrevocable offer of dedica not accepted at that time.
The City is now finalizing the plans for the improvement of Laguna Drive location. The planned improvements consist of installing curb, gutter and on the north side of Laguna Drive between State Street and Jefferson Str overlaying the entire street with a 2-inch layer of new asphalt. The ac of the irrevocable offer of dedication will complete the right-of-way acq for the improvement project, except for the property located at the n corner of Jefferson Street and Laguna Drive. A total of nine property including the irrevocable offer of dedication, have finalized the dedications at no cost to the City. Sidewalk, curb and gutter will constructed a1 ong the frontage where right-of-way has not been obtainec though negotiations with the property owners of that location are at an the missing right-of-way will have a minimal impact on the utility of the
ENVIRONMENTAL REVIEW:
The project that will construct the improvements on the land covered easement has been granted a Negative Declaration by the Planning Dirt January 10, 1991.
FISCAL IMPACT:
There are no fiscal impacts associated with the acceptance of this irr offer of dedication. Furthermore, acceptance of the offer means the City have to pay for the easement necessary for the construction of the improve this location.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING AN IRREVOCABLE OFFER OF
DEDICATION FOR STREETS AND HIGHWAY PURPOSES AND DIRECTING THE CITY CLERK TO CAUSE SAID ACCEPTANCE TO BE
RECORDED IN THE OFFICE OF THE COUNTY RECORDER
WHEREAS, Dr. and Mrs. Thomas H. Hayes are the owners of the
located at 570 Laguna Drive, Assessor's Parcel No. 155-221-12; and
WHEREAS, an irrevocable offer of dedication to the City of Cai
streets and highway purposes was made by the property owners per
75-128302 recorded May 27, 1975; and
WHEREAS, the City of Carlsbad deemed it not to be in the publi
to accept said irrevocable offer of dedication at that time; and
WHEREAS, the City Council of the City of Carlsbad now deems it tc
public interest to accept said irrevocable offer of dedication for s
highway purposes.
