RECOMMENDED ACTION:
Adopt Resolution No. 9 3 -ac approving the map of Reversion to Acreage RA 92-l.
ITEM EXPLANATION:
Bristol Cove Partners II has requested a reversion to acreage of its solely owned Parcel
Map No. 16262. This request for reversion to acreage was denied by the City Council on
August 16, 1992 because of an objection from one of the general partners. All three
partners now consent to the reversion and have signed the map. The owner-applicant
has cited inability to obtain financing for the project as their reason for the request.
The project is located on the south side of Harrison Street westerly of Adams Street. The
project is a one lot condominium project containing four units. If reverted, the property
would become a legally conforming unimproved lot with no condominium units approved.
The reversion will also require the rescinding of Condominium Permit CP 87-2 and Hillside
Development Permit HDP 89-42 which were approved with the parcel map. Such action
has been incorporated in the approving resolution.
The City will retain a four foot wide street dedication along the south side of Harrison
Street and a 15 foot wide easement for a walking trail along an existing sewer easement.
These dedications were made on Parcel Map 16282 and are reserved from this reversion
to acreage.
A IO foot wide sewer easement dedicated to the City on Parcel Map 16282 will not be
retained with this reversion to acreage. This easement is not needed for any present or
future public purposes. It was dedicated for the sewer system needed to serve Parcel
Map No. 16282 and the condominium project approved with the parcel map.
The owner-applicant also requested release of obligations under the subdivision
improvement agreement and return of any unused fees. There are no unused fees to be
returned. Per Municipal Code Section 20.40.070 the release of obligations under the
agreement have been incorporated in the approving resolution,

A RESOLUTION OF THE CR-Y COUNCIL OF THE CllY OF
CARLSBAD, CALIFORNIA, APPROVING A MAP FOR
REVERSION TO ACREAGE RA 92-l.
WHEREAS, Bristol Cove Partners II, a Partnership has submitted a map known as
Reversion to Acreage No. 92-l to the city of Carlsbad for approval; and
WHEREAS, Bristol Cove Partners II is the sole owner of the property being reverted,
and
WHEREAS, the map of RA 92-l meets the requirements of the Carlsbad Municipal
Code and the Subdivision Map Act, and
WHEREAS, the City retains a four foot wide dedication of street along Harrison Street
as shown on the Map of RA 92-1, and
WHEREAS, the City retains a 15 foot wide easement for a walking trail as shown on
the map for RA 92-1, and
WHEREAS, the 10 foot wide sewer easement shown on the map for RA 92-l as being
reverted is not needed for present or prospective public purposes, and
WHEREAS, the Cii Council of the City of Carlsbad, on this date held a public hearing
to consider the recommendation and hear all persons interested in or opposed to RA 92-1,
and
WHEREAS, the City Council of the City of Carlsbad has determined R to be in the
public interest to approve said map.
NOW, THEREFORE, BE ff RESOLVED by the City Council of the City of Carfsbad,
California, as follows:
1. That the above recitations are true and correct.
2. The said map known as Reversion to Acreage RA 92-l from Bristol Cove
Partners II which is on file wfth the City Engineer and is incorporated herein by reference, is
3. That upon proof of the recording of Map BA 92-1 Bristol Cove Partners II shall

2 be released from the obligations contained in the Subdivision Improvement Agreement
3 between the City and Bristol Cove Partners II dated August 20, 1999
4 4. That Condominium Permit No. CP 87-2 and Hillside Development Permit No.
5 HDP 89-42 are hereby rescinded.
6 5. That the City Clerk is authorized to sign the Certificate of Vacation of Easement
7 on the map.
8 8. That the Cii Clerk is authorized to release the map, RA 92-l to Commonwealth
g Land Title Insurance Company for recording in the Office of the County Recorder of San

NOTICE IS HEREBY GIVEN that the City Council of the City of Carlsbad will hold a public hearing at the City Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:DO P.M., on Tuesday, February 2, 1993, to consider a request to revert a one parcel four unit condominium map to a one lot unimproved subdivision with no condominium units approved, on property generally located on
the south side of Harrison Street, west of Adams Street and more particularly
described as:
Parcel 1 of Parcel Map No. 16282, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, November 5, 1990, as Instrument No. go-598742 of Official Records.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City Council of the City of Carlsbad will hold a public hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California at 6:00 p.m. on Tuesday, to consider a request for a
reversion to acreage on property generally located on the south side of Harrison Street west of Adams Street and more particularly
described as:
This request is to revert a one parcel four unit condominium map to a one lot unimproved subdivision with no condominium units approved.
Parcel 1 of Parcel Map No. 16282, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, November 5, 1990 as Instrument No. go-598742 of Official Records.
Those persons wishing to speak on this proposal are cordially invited to attend the public hearing. If you have any questions, ev rim--k at 434-2808. _
