Adopt Resolution No. 92-26 approving plans and specifications and authorizing City Clerk to advertise for bids for the construction of improvements to Lac Drive between State Street and Jefferson Street, Project No. 3001.
ITEM EXPLANATION:
This project proposes to improve Laguna Drive between State Street and Jeffer Street. The following improvements are included as major elements of the projc
Construction of curb, gutter and sidewalk on the north side of Laguna Dri ve.
rn Full street improvements along the north side of Laguna Drive.
Modify the vertical roadway alignment by flattening out the vertical curve located just east of State Street in order to meet sight distance requirements.
Overlay the entire street with a 2-inch layer of new asphaltic concrete.
Construct driveways and transitions into private property.

rn Plant trees on adjacent properties in order to comply with the Coas Commission Permit.
Pedestrian ramps will be added to the north side of Laguna Drive abutting the e and west side of Kremeyer Circle which already contains curb, gutter and sidewa No improvements are proposed to the south side of the street due to encroachm problems into the ultimate right-of-way. It is anticipated that the improvemei in the south side of the street will be constructed when the frontage propert. redevel op.
This project is a portion of the original Downtown Improvement Program establisl in FY 84-85. Since then, portions of this project also became a part of the Lot Street/Sidewalk Upgrade Program as identified in the Citywide Sidewalk Inventc Report prepared by the Engineering Department in February 1991. A force main \ constructed in 1992 along Laguna Drive. Maxton Brown Park improvements, includ., curb, gutter and sidewalk, were also constructed in 1992. Currently, San Diego C and Electric is undergrounding overhead utilities along this street as part of t Underground Utility District No. 12. Pole removal is expected to occur May 1993. This project will follow pole removals and complete the north si street improvement and overlay the entire street.
ENVIRONMENTAL REVIEWS:
The Planning Director issued a Negative Declaration for this project January 10, 1991.

CALIFORNIA COASTAL COMMISSION REVIEWS:
The California Coastal Commission issued a Notice of Intent to Issue Permit this project on September 15, 1992. The Coastal Development Permit will be iss upon presentation and approval of the landscape plan which is a part of the proj pl ans.
DESIGN REVIEW BOARD REVIEWS:
A Minor Redevelopment Permit and Coastal Development Permit for the portion of project within the Redevelopment Zone were approved by the Design Review Boarc October 7, 1992.
RIGHT-OF-WAY STATUS:
All right-of-way required to construct the project has been obtained, except a portion of the needed right-of-way owned by Dr. and Mrs. George M. Soohoo loca on Assessor’s Parcel No. 155-170-20. This property is located at 2685 Jeffer Street, which is a corner lot at the northwest corner of Jefferson Street Laguna Drive. Without the easement that staff has repeatedly asked the owner dedicate, the curb, gutter and sidewalk in front of this parcel facing Laguna Dr cannot be constructed. However, this 76-foot long portion of missing sidewalk w have a minimal impact on the balance of the project. Dr. Soohoo has been notif that by not dedicating the easement at this time, the missing portion of sidew and all related improvements will be a condition of any future development of parcel.
GENERAL PLAN CONSISTENCY:
The P1 anning Commission Determination for General P1 an Consistency was approved February 20, 1992.
FISCAL IMPACT:
Estimated project costs are as follows:
Design & Design Administration $ 55,000 Estimated Construction Cost 163,000 Construction Contingencies (10%) 16,300 Inspection/Administration (10%) 17,900
TOTAL PROJECT COST ESTIMATED $252,200
The above estimated costs will be financed by funds from two sources. A total $250,000 was appropriated for the Downtown Improvement Program in FY 84-85 i FY 85-86 from redevelopment agency funds, Project Number 3001. Over the years, tt appropriation has funded the design of several sidewalk improvement projects. 1 current balance in this fund is $113,760 (as of 12/31/92). A second source funds will come from the previously appropriated $600,000 (Project Number 3391) 1 the Local Street/Sidewalk Upgrade Program, which was funded from Traffic Impb Fees ($300,000) and from TransNet-Proposition A sales tax ($300,000). It estimated that approximately $140,000 will be used from this program,

Upon project completion, the City will request reimbursement from one propc owner along Laguna Drive who is obligated to pay in accordance with a Fu- Improvement Agreement established with the City. When received, the funds \ reimburse the Traffic Impact Fee fund. It should be noted that the request reimbursement will not be made until after construction is complete and final cc are known.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS
AND AUTHORIZING THE CITY CLERK TO ADVERTISE FOR BIDS FOR THE CONSTRUCTION OF IMPROVEMENTS TO LAGUNA DRIVE.BETWEEN
STATE STREET AND JEFFERSON STREET, PROJECT NO. 3001.
WHEREAS, the City Council of the City of Carlsbad has determined
necessary, desirable, and in the public interest to construct improvements
Laguna Drive between State Street and Jefferson Street; and
WHEREAS, plans, specifications, and contract documents for the furnist
for all labor, materials, tools, equipment, transportation, and other exper
necessary or incidental for said project have been prepared and are on filf
the Engineering Department of the City of Carlsbad; and
WHEREAS, the City Council of the City of Carlsbad had previoi
appropriated funds for said project; and
WHEREAS, construction for said improvements is a matter of public necesi
and safety.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsl
California, as follows:
1. That the above recitations are true and correct.
2. That the plans, specifications, and contract documents as presei
are hereby approved.
3. That the City Clerk of the City of Carlsbad is hereby authorized
directed to proceed to publish, in accordance with law, Notice to Contrac
