ACTION: I Introduce Ordinance No. /21 s-235 amending Title 2 of the Carlsbad Municipal.Code by the revision of Chapter 2.40 to replace previous provisions for a Housing and Redevelopment Advisory Committee with new provisions for a Housing Commission. On July 14, 1992, the League of Women Voters presented a proposal to the City Council requesting creation of a City Housing Commission to address affordable housing issues within Carlsbad. Staff was directed to discuss the matter further with the League, evaluate the proposal, including its fiscal impact to the City, and develop a recommendation for review by the City Council. Staff met with the League of Women Voters on October 29, 1992 to discuss the proposed Housing Commission. Also, staff completed a survey of functions and memberships of Housing Commissions in other cities. Based on staff's evaluation of the proposal, it is recommended that the City Council review and adopt an ordinance amendment to establish a Housing Commission to advise the Housing and Redevelopment Commission and/or City Council as either body may request on issues involving, but not limited to, the following: 0 establishment or amendment of affordable housing programs, policies and regulations; l establishment of affordable housing agreements; and 0 review of affordable housing projects including project concept, affordability objectives and requests for city participation or incentives. Staff recommends that the Housing Commission consist of seven (7) members to include two (2) tenants assisted by the Carlsbad HousingAuthority, one (1) member of the Planning Commission, and four (4) citizens with experience and expertise within the fields of development, construction, real estate, social services, housing advocacy, planning, architecture and/or finance. The attached ordinance will revise Chapter 2.40 of the l Municipal Code to replace previous provisions for the Housing and Redevelopment Advisory Committee (HRAC) with new provisions for the Housing Commission. Adoption of the attached ordinance will result in the elimination of HRAc. It is staff's recommendation that the functions of HRAC be absorbed by the Housing Commission and/or other existing committees/boards and/or commissions. The new division of responsibilities is outlined in Exhibit 2. There is no legal requirement to continue HRAC. If the Housing Commission is approved, it can assume HRAC’s role as advisor on housing related issues, including the Section 8 Rental Assistance Program. For redevelopment issues or concerns, the Master Plan Advisory Committee can make recommendations to the Housing and Redevelopment Commission until the Master Plan is complete and, then, the role of the Design Review Board could be expanded to serve this need. A subsequent revision to Chapter 2.26 of the Carlsbad Municipal Code will be required to revise the membership of the Design Review Board and its function(s). . P-C= I’MPACT. The new ordinance will result in the need for staff to spend more time on providing support to the new Housing Commission. However, existing staff will be used to support the Housing Commission. Therefore, no additional impact on the general fund is anticipated at this time for staffing purposes. NS-235 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2 OF THE CARLSBAD MUNICIPAL CODE BY REPEALING CHAPTER 2.40 AND ADDING A NEW CHAPTER 2.40 TO ESTABLISH A HOUSING COMMISSION WHEREAS the City declared on November 6, 1979 in Ordinance No. 1223 a need for both a Housing Authority and Redevelopment Agency pursuant to Health and Safety Code Section 34110; and WHEREAS the City declared the need for the joint operation of the Housing Authority and Redevelopment Agency as a Community Development Commission; and WHEREAS at that time the City Council declared itself to be the commissioners of the joint commission; and WHEREAS the City of Carlsbad reaffirms the need for a, Housing Authority without effecting the previous declaration; and WHEREAS the City,of Carlsbad declares that a Housing Commission formed pursuant to Health and Safety Code Section 34291 is necessary for the implementation and formation of various housing programs, NOW THEREFORE, the City Council of the City of Carlsbad, does ordain as follows: SECTION 1: Chapter 2.40 of Title 2 of the Carlsbad Municipal Code is repealed and a new Chapter 2.40 is added to read as follows: F c E s 1C 11 12 12 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 "Chanter 2.40" ,HOUSING COMMISSION Sections: 2.40.010 Established. 2.40.020 Membership. 2.40.030 Qualifications. 2.40.040 Meetings. 2.40.050 Vote required. 2.40.060 Functions. 2 40.010 Established. . Pursuant to Section 34291 of the California Health and Safety Code, a Housing Commission is created as an advisory body to the City Council and Housing and Redevelopment Commission. 2.40.020 Membershin. The Housing Commission shall consist of seven (7) members. The members shall be appointed by the Mayor and confirmed by the City Council. After the initial term, the members shall serve four year terms with the exception of the Planning Commission member who shall serve a two year term; and each member shall serve until their successor is duly appointed and qualified. The initial members of the Commission shall-serve stdggered terms as follows: 1. The Planning Commission member shall serve for a period of two (2) years; 2. Three members.shall serve for a period of three (3) years; and, 3. Three members shall serve for a period of four (4) years. Members shall serve without compensation. Members of the Commission may be removed by the Mayor with the consent of , the City Council. 1 8 9 10 11 12 13 14 15 16 17 18 19 20 23. 22 23 24 25. 26 2 /I 2.40.030 Qualifications. All members of the Housing Commission shall reside, work or own a business or property within the City limits of Carlsbad. In addition, two (2) members of the Housing 3 4 5 Commission shall be tenants assisted by the Carlsbad Housing 6 Authority, one (1) of which shall be at least 62 years of 7 age. One (1) member shall be a member of the Planning Commission. The remaining four (4) members shall, to the extent possible, have experience and expertise within one or more of the following areas: development, construction, real estate, social services, housing advocacy, planning, architecture and/or finance. .To the extent possible, the Commission members shall be representative of the four quadrants of the City. If a tenant member ceases to be a tenant assisted by the Authority and,a non-tenant member ceases to reside, work or own a business or property within the city limits of the City of Carlsbad, his/her membership on the Commission shall terminate and another member shall be appointed for the remainder of the unexpired term. 2.40.040 Meetinas. The Housing commission shall meet regularly, on days. and times established by the Commission for the transaction of business. The Commission may adjourn any regular meeting to a time and place specified at the regular meeting and any such adjourned meeting shall be deemed a regular meeting. The rules,and procedures of the Planning Commission shall be modified, as necessary, and approved by the Housing Commission for the conduct of its business. 2.40.050. Vote recuired. Four members of the Housing Commission shall constitute a quorum. The affirmative vote of four members shall be necessary for any action by the Commission. 2.40.060 Functions. The Housing Commission shall advise and make recommendations to the Housing and Redevelopment Commission and/or the City Council as either body may request, including but not limited to the following: 0 establishment. or amendment of affordable housing programs, policies and regulations; : 0 establishment or implementation of affordable housing agreements; and 0 review of affordable housing projects including project concept; affordability objectives; and, requests for City participation or incentives. Where appropriate, and particularly with respect to affordable housing projects, the Housing Commission shall provide its advice to and coordinate its reviews with the Planning Commission. For purposes of the Housing Commission, an affordable housing project shall be defined as a project that provides housing to households of lower income or below as defined by the Housing Element of the ~ General Plan, and proposes use of City-provided development incentives. EFFECTIVE DATE: The ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the City Council of the City of Carlsbad, California, held on the 6th day of APRIL , 1993, and thereafter.
