NS-235 CITY CREATING A HOUSING COMMISSION MTG.&LL3,ll DEPl DEPT.~ CITY RECOMMENDED ACTION: Adopt Ordinance No. NS-235, amending chapter 2.40 of the Carlsbad Municipal Coc to replace previous provisions for a Housing and Redevelopment Advisory Commit1 with new provisions for a Housing Commmission. ITEM EXPLANATION Ordinance No. NS-235 was introduced at the regular City Council meeting of April 1993. The second reading allows Council to adopt the ordinance which would th become effective in thirty days. The City Clerk will have the ordinance published in t "Carlsbad Sun'! within fifteen days, if adopted. FEKAL IMPACT See Agenda Bill No. 12,150 on file with the City Clerk. EXHIBIT 1. NS-235 1 2 3 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2 OF THE CARLSBAD MUNICIPAL CODE BY REPEALING CHAPTER 2.40 AND ADDING A NEW CHAPTER 2.40 TO ESTABLISH A HOUSING COMMISSION I 5 11 6 9 Redevelopment Agency pursuant to Health and Safety Code 8 Ordinance NO. 1223.a need for both a Housing Authority and 7 WHEREAS the City declared on November 6, 1979 in Section 34110; and 10 WHEREAS the City declared the need for the joint 11 12 operation of the Housing Authority and Redevelopment Agenc 15 to be the commissioners of the joint commission; and 14 WHEREAB at that time the City Council declared itselj 13 as a Community Development Commission; and WHEREAS the City of Carlsbad reaffirms the need for i 16 Housing Authority without effecting the previous 17 declaration; and 18 WHEREAS the City of Carlsbad declares that a Housing 19 Commission formed pursuant to Health and Safety Code Sect 20 34291 is necessary for the implementation and formation o 21 various housing programs, 22 NOW THEREFORE, the City Council of the City of 23 is added to read as follows: 26 Carlsbad Municipal Code is repealed and a new Chapter 2.4 25 SECTION 1: Chapter 2.40 of Title 2 of the 24 Carlsbad, does ordain as follows: 27 28 /I e 0 L. 1 2 3 4 5 6 "ChaDter 2.40" ,HOUSING COMMISSION Sections: 2.40.010 Established. 2.40.020 Membership. 2.40.030 Qualifications. 2.40.040 Meetings. 2.40.050 Vote required. 2.40.060 Functions. 7 created as an advisory body to the City Council and Housir 9. California Health and Safety Code, a Housing Commission is 8 2.40.010 Established. Pursuant to Section 34291 of t 10 and Redevelopment Commission. 11 2.40.020 ,Membership. The Housing Commission shall -12 13 consist of seven (7) members. The members shall be appoint initial members of the Commission shall serve staggered 18 their successor .is duly appointed and qualified. The 17 serve a two year term; and.each member shall serve until 16 the exception of the Planning Commission member who shall 15 initial term, the members shall serve four year terms wit1 14 by the Mayor and confirmed by the City Council. After the 19 terms as follows: 20 1. The Planning Commission member shail serve for i 21 period of two (2) years; 22 2. Three members shall serve for a period of four . 27 Commission may be removed by the Mayor with the consent o 28 ', I/ 0 the City Council. 1 2.40.030 Oualifications. 0 2 3 4 All members of the Housing Commission shall reside, work o own a business or property within the City limits of Carlsbad. In addition, two (2) members of the Housing Commission shall be tenants assisted by the Carlsbad Housi 5 6 I( Authority, one (1) of which shall be at least 62 years of 7 age. One (1) member shall be a member of.the Planning Commission. The remaining four (4) members shall, to the 8 9 10 11 12 13 14 15 16 17 18 19 20 'I extent possible, have experience and expertise within one more of the following areas: development, construction, real estate, social services, housing advocacy, planning, architecture and/or finance. the extent possible, the Commission members shall be representative of the four quadrants of the City. If a tenant member ceases to be a tenant assisted by the Authority and a non-tenant member ceases to reside, work t own a business or property within the city limits of the City of Carlsbad, his/her membership on the Commission shi terminate and another member shall be appointed for the remainder of the unexpired term. 21 22 2.40.040 Meetinas, The Housing Commission shall mee regularly, on days and times established by the Commissio 23 11 for the transaction of business. The Housing Commission shall 9 advise and make recommendations to the Housing and 10 11 Redevelopment Commission and/or the City Council as eithe: body may request, including but not limited to the 12 13 14 following: 0 establishment or amendment of affordable housing programs, policies and regulations; 1511 . establishment or implementation-of affordable housin l6 /I agreements; and 17i/ review of affordable housing projects including proj 18 19 concept; affordability objectives; and, requests for City participation or incentives; and the Commission shall annually report to the City 201 0 21 22 Council- on the status and progress of affordable housing programs. 23 24 25 26 27 Where appropriate, and particularly with respect to affordable housing projects, the Housing Commission shall provide its advice.to and coordinate its reviews with the Planning Commission. For purposes of the Housing 28 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 m Commission, an affordable housing project shall be define1 as a project that provides housing to households of lower income or below as defined by the Housing Element of the General Plan, and proposes use of City-provided developme incentives. ,EFFECTIVE DATE: The ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it ta published at-least once in the Carlsbad Journal within fifteen days after its adoption.
