RECOMMENDED ACTION: GENERAL PLAN, LOCAL COASTAL PROGRAM AND ZONING DESIGNATIONS FOR AN AREA GENERALLY LOCATED IN THE CI' PLN CP"fM CI' SOUTHERN PORTION OF THE BEACH AREA OVERLAY ZONE - If the Council concurs both the Planning Commission and staff are recommending that Council ADOPT Resolution No. 9 3 -1 08' , APPROVING the Negative Declaration issue1 Planning Director; ADOPT Resolution Nos.? 3- 104 , and 93 -/Lo , APPROVING GP. and LCPA 92-02; and INTRODUCE Ordinance No, 0 S - 2-3 3 , APPROmG ZC 92-( ITEM EXPLANATION On February 3, 1993, the Planning Commission conducted a public hearing to cons above referenced project regarding the modification of land use designations within tl area as shown on the attached location map. The proposed changes to existing General Plan, and Local Coastal Program designations result from a City Council ~ recommendation made by the North Beach Planning and Traffic Study (Nov. 1987 recommendation was to study the desirability of maintaining the study area as all R- family zoning since currently an unusual mixture of R-1 and RD-M (multi-family exists. A detailed overview of the land use study's background, scope of issues h solicitation of property owner input and final recommendations is contained in the z Planning Cornmission staff report. In brief, the proposal involves primarily the implementation of the R-2 zone over t€ area (with two exceptions) which will balance out the. extremes of the existing situation and be most responsive to the property owner input received regarding the regulate against multi-family product types which may degrade neighborhood charact# proposal will also eliminate existing inconsistencies between zoning and Gener designations. The existing and proposed designations are shown as attachments in tl LCPA and ZC Resolutions. At the February 3 hearing, no comments were received du public testimony and the Planning Commission voted unanimously to recommend app the proposed land use designation changes. II. PROJECI' DEscRIpTlON AND BACKGROUND In 1987, a study titled the North Beach Planning and Traffic Study (NBPTS) completed. The NBPTS addressed various traffic and land use issues within what is : I the Beach Area Overlay Zone (BAOZ). In November 1987 the City Council adopted sel recommendations of the NBPTS. The subject of this proposed action (general amendment, local coastal program amendment and zone change) addresses one of recommendations of the NBPTS adopted by the City Council in November 1987. In looking at traffic issues and land uses for the beach area, the. NBPTS identified s residential areas that either were developing or had the potential to develop land incompatibilities between smaller scale single family residences and larger scale m the neighborhood was raised by the NBPTS and was expressed in the form 1 recommendation. family projects. For each of these five areas the NE recommended that the City "should conduct public hearings to obtain citizen input or desirability of placing the study area in R-1 zoning and also the RM General Plan categ Should these areas remain R-1 it would also be desirable to encourage the formation 04 or more neighborhood associations." In November of 1987, the City Council adopted this recommendation for two of the study areas. This report and recommendation focuses on one of the study areas loci in the southern portion of the BAOZ around the southern terminus of Garfield Street. study area has 35 lots involved as shown on the attached location map. This I primarily has smaller scale single family and duplex developments with several lots thar either vacant or could be redeveloped. The development of these lots could significa change neighborhood character. Existing zoning and General Plan designations are shl on Exhibit "A". As shown, the existing zoning for this area is a non-compatible mi zoning and the General Plan in the form of some single family R-1 lots that have a 1 density RH (Residential-High). or RMH (Residential-Medium High) General : designation. In addition to the land use compatibility and neighborhood character iss this area is served by an extended cul-de-sac street system with one access point (Gar St). Because of this, the issue of emergency vehicle access and response for this area to be addressed by this land use study. This neighborhood was studied first because of the issues described above and becau zone change application for a single family R-1 lot on the south side of Chinquapin wi the study area in 1991 has acted as a catalyst for the land use study to commence. CIRCULATION IMPACTS ON LAND USE DENSITIES As mentioned the study area is currently served by an extended cul-de sac SI system that violates the Engineering Department's cul-de-sac policy. The policy Specifically, this street system exceeds (1) the 600 foot length maximum; (2) 50 dwelling units cap; and (3) the 500 ADT traffic limit. This represents the mix of the two designations within study area. Several owners of existing R-1 lots or lots under 7,000 square i favored the R-1 single family zoning while property owners of larger sized lots M the current allowance to build multi-family type projects did not. As such, this proposal recommends the designations shown on exhibits "B" and The R-2 zone is proposed to balance out the extremes of the incompatible zor designations while allowing developments of a reasonable scale and densit] occur. A lot's allowable density within the study area would be based on the size and General Plan designation's density range. Two units would be allowec lots with a minimum lot size of 7500 square feet. In addition, the R-2 zone more single family-like development standards (20 foot front yard setbacks and allowed lot coverage) as compared to the multi-family RDM zone. Therefor1 duplex or twin home neighborhood may ultimately develop as opposed to a mixi of high density multi-family projects adjacent to single family residences. The proposal to introduce the R-2 zone, therefore, is more of a product type con instead of a downzoning of the study area. Multiplying each lot in the study : by its existing and proposed designations shows that the proposed scenario c( yield a theoretical maximum of 70-103 units while the existing scenario could y approximately 94-132 units maximum. In reality, several properties have and continue to have single family residences. Also, these numbers are approximate do not consider compliance with development and design standards. However, proposal does not represent an intensification of the residential land uses of study area thus rendering the existing street system adequate for fu development. Staff is proposing two exceptions to the R-2 zoning. First, the south sidl Chinquapin would have the single family islands eliminated and replaced with fi GPA 92-O9/LCPA 92-0 9 /ZC 92-01 . The two eastern lots on south side of Chinquapin are proposed for R-2/RM designations. The redr densities for these lots is reflective of property owner input and the goal! reducing development impacts to this area. The second exception is the existin2 unit condo project at the south-eastern end of Olive Avenue. By maintaininj existing designations, this lot will not become any more non-confonning to cur codes. With this proposal, General Plan and zoning is in conformance for each lot wi the study area. The staff proposed designations are an equitable solution to neighborhood compatibility concerns that exist within the study area. A. MELLO I1 LOCAL COASTAL PROGRAM Implementing the proposed land use designations would require a Local Co; Program Amendment (LCPA). The Mello I1 LCP designates this area as Med High Density with a corresponding RDM zoning classification. The LCPA modify these current designations to reflect the proposed General Plan designa modifications and zoning changes including the introduction of the R-2 zone. proposal will not adversely impact any of the issues the LCP regulates includ land uses, grading, coastal access, natural resource protection, etc. B. ZONE 1 LOCAL FACILITIES MANAGEMENT PLAN Since implementing the proposed land use designations does not involve increa densities or allowable units, this project complies with the Zone 1 Local Fad Management Plan. In fact, this proposal slightly reduces the maximum pote density in this area so there may be less of a demand for services than with ex& designations. Future projects will undergo environmental review and a Stan assessment of impacts to facilities and services so that all growth managel performance standards will be maintained. Eric Munoz, Associate Planner, reviewed the background of the request and stated that the Beac Land Use Study came as a result of the North Beach Planning and Traffic Study (NBPTS) which in the late 1980's. In looking at traffic issues and land uses for the beach area, the NBPTS identii residential areas that either were developing or had the potential to develop land use incompatibil between smaller scale single family residences and larger scale multi-family projects. The issue preserving the existing single family character and scale of the neighborhood was raised by the b and was expressed in the form of a recommendation. The area being addressed tonight is locate southern portion of the Beach Area Overlay Zone (BAOZ) around the southern terminus of Garfie The study area has 35 lots containing smaller scale single family and duplex developments, with lots that are either vacant or could be redeveloped. The development 'of these lots could significa change neighborhood character. The existing zoning is a non-compatible mix of single family ar multi-family zoning. Staff conducted a land use study that included a series of certified mailings to all property owner5 the study area. Over a three month period, staff solicited and assessed all input regarding the de of retaining R-1 zoning with an RM density. Input was received from all but five property owners on the research and input reviewed during the land use study, staff is recommending the implem of several zone changes and General Plan designations to eliminate the current conflicts within tl area. Using an overhead projection, Mr. Munoz showed diagrams of the proposed zoning and General designations and discussed in detail each of the proposed changes and its effect. Chairman Noble stated, for the record, that he had received a letter from Mr. and Mrs. Kelly, resic the study area. He inquired if their property would be affected. Mr. Munoz replied that the propo changes would have no effect on the Kelly's property. However, the Kellys currently have two un property, which is a non-conforming use. If they were to redevelop their property, they would on allowed one unit. Commissioner Hall inquired if everyone in the study area was noticed about tonight's hearing. M replied that they were. In addition, it was also noticed in the newspaper. He received several tek calls from people inquiring about the hearing.
