NS-238 - MTG.=l ESTABLISH DISTANCE A PARKED VEHICLE CITY A DEPT. cLK MUST MOVE AFTER 72 HOURS CITY N RECOMMENDED ACTION: Adopt Ordinance No. NS-238, amending Title 10 of the Carlsbad Municipal Code tc establish one-tenth of a mile (528 feet) as the minimum distance that a parked vehicle must move after 72 consecutive hours. ITEM EXPLANATION Ordinance No. NS-238 was introduced at the regular City Council meeting of April 20 1993. The second reading allows Council to adopt the ordinance which would the1 become effective in thirty days. The City Clerk will have the ordinance published in thf "Carlsbad Sun" within fifteen days, if adopted. FISCAL IMPACT See Agenda Bill No. 12,181 on file with the City Clerk. EXHIBIT 1. NS-238 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.40, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION 10.40.010 TO DISTANCE THAT A PARKED VEHICLE MUST MOVE AFTER 72 CONSECUTIVE HOURS. The City Council of the City of Carlsbad, California, hereby ordains as folk SECTION 1 : That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is . ESTABLISH ONE-TENTH OF A MILE (528 FEET) AS THE MINIMUM by the revision of Section 10.040.010, to read as fcllows: "1 0.40.01 0 Parking for seventy-two or more consecutive hours prohibited-Removal of vehicle. (a) No person shall cause or allow any vehicle owned by him or in his PC custody or control, to be parked upon any street, alley or publicly owned parking lot fo two or more consecutive hours. (b) For the purpose of this section, a vehicle shall be deemed to be lefl when such vehicle has not been moved more than one-tenth of a mile (528 feet) und power from its original stopped position. (c) Any member of the police department may remove any vehicle parked street, alley or publicly owned parking lot for seventy-two or more consecutive hours upon such removal, deal with such vehicle as provided in Section 22650 through 22 Vehicle Code of the State."
