RECOMMENDED ACTION:
Adopt Ordinance No. NS-239, amending Title 10 of the Carlsbad Municipal Code
establish a prima facie 35 mile per hour speed Emit upon Avenida Encinas fro
Poinsettia Lane to a point 3,000 feet northerly.
IlTM EXPLANATION
Ordinance No. NS-239 was introduced at the regular City Council meeting of April 2
1993. The second reading allows Council to adopt the ordinance which would th
become effective in thirty days. The City Clerk will have the ordinance published in t
"Carlsbad Sun'' within fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD
MUNICIPAL CODE BY THE AMENDMENT OF SECTION 10.44.280 TO ESTABLISt
A PRIMA FACIE 35 MILE PER HOUR SPEED LIMIT UPON AVENIDA ENCINA:
FROM POINSETTIA LANE TO A POINT 3,000 FEET NORTHERLY
WHEREAS, the City Council of the City of Carlsbad, California, hereby ordains as
SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is a
CALIFORNIA, AMENDING TITLE IO, CClAPTER 10.44, OF THE CARLSBk
by the revision of Section 10.44.280 to read as follows:
"1 0.44.280 Avenida Encinas:
a. Upon Avenida Encinas from Poinsettia Lane to a point 3,000 feet
northerly, the prima facie speed limit shall be thirty-five miles per
hour.
Upon Avenida Encinas from Palomar Airport Road to its intersection
with Cannon Road, the prima facie speed limit shall be forty miles
per hour.
b.
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its ado
