ITEM EXPLANATION: reimbursing Traffic Impact Fees to Johnsoi On February 1, 1989 the Planning Commission adopted Resolution No. 281 2 app SDP 86-1 1 (A) for the Plaza Paseo Real Shopping Center at the corner of El Caminl and Alga Road. A condition placed on this shopping center as part of th Development Plan approval was for the construction of intersection improvement Camino Real and Alga Road. The construction requirements included the wider both roadways, median improvements including colored concrete and traffic modifications. These improvements have since been satisfactorily comple accordance with the approved street improvement plans. An accounting construction invoices indicated that the street improvements cost $404,000 to cor During the approval process and subsequent construction of the Plaza Pase Shopping Center, City staff was completing a study which revised the Traffic Imp2 (TIF) program. A lower Traffic Impact Fee of $1 19,568.00 was collected with issu: building permits for the shopping center with an understanding that appr adjustments will be made upon adoption of the revised TIF program and the corn of the required intersection improvements. On October 1, 1991 the City Council adopted the TIF program which establishec structure to fund construction of various circulation facilities throughout the c accordance with the newly adopted fee structure, the Plaza Paseo Real Shopping is obligated to pay a TIF of $340,230. The TIF program further recommended that of $250,000 be appropriated to fund the intersection improvements at El Camino Rc Alga Road. Since the Johnson Wax Development Company built a circulation facility identifiei adopted TIF program, they are eligible for a $250,000 credit and reimbursement paid in excess of their total obligation. FISCAL IMPACT: The total reimbursement for Johnson Wax Development Company is $2 Reimbursement of these fees have no effect on the scheduling and funding o circulation facilities as outlined in the adopted Traffic llmpact Fee Program. I 5 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 l7 18 19 0 0 RESOLUTION NO. 93-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLS BAD, CALIFORNIA REIMBURSING TRAFFIC IMPACT FEES TO JOHNSON COMPANY WAX DEVELOPMENT WHEREAS, the City Council of the City of Carlsbad, California on October 1 adopted the Traffic Impact Fee program authorizing the collection of fees to fund v circulation facilities within the City: and WHEREAS, the City Council of the City of Carlsbad, California on October 1 adopted Resolution No. 91 -326 approving a list of circulation facilities which are to be ' through the collection of Traffic Impact Fees and included the intersection of El Camir and Alga Road; and WHEREAS, Resolution No. 91 -326 established the estimated costs associatt intersection improvements at El Camino Real and Alga Road at $250,000; and WHEREAS, the Johnson Wax Development Company received approval Development Plan No. 86-1 1 (A) which contained a condition requiring the construc intersection improvements including traffic signal modifications at El Camino Real ai Road intersection; and WHEREAS, the Johnson Wax Development Company completed the r intersection improvements in accordance with the approved street improvement plan 1 20 21 22 23 24 25 26 27 28 satisfaction of the City Engineer; and WHEREAS, Traffic Impact Fees were assessed in conjunction with the issu building permits for the shell buildings constructed by Johnson Wax Developmer amount of $1 19,568; and WHEREAS, it is necessary to adjust the Traffic Impact Fees with respect to th Impact Fees associated with the Plaza Paseo Real Shopping Center and the con! costs affiliated with the required intersection improvements.
