RESOLUTION NO. 93-164
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, DIRECTING THE CITY ENGINEER TO GIVE NOTICE TO
CONNECTTO UNDERGROUND AND TO PROVIDE SUCH CONNECTION
IF NECESSARY TO CERTAIN PROPERTIES WITHIN UNDERGROUND
UTILITY DISTRICT NO. 13
WHEREAS, on September 3, 1991, the City Council of the City of Carlsbad adopted
Resolution No. 91-291 establishing Underground Utility District No. 13 requiring the removal of
overhead wires and construction of underground utilities; and
WHEREAS, on March 2,1993, the City Council of the Ctty of Carlsbad adopted Resolution
No. 93-43 setting the date by which property owners must be ready to connect to the
underground service as of March 22, 1993; and
WHEREAS, the following properties have, to date, not been made ready to connect to
underground service:
41 1 TAMARACK AVENUE
421 TAMARACK AVENUE; and
WHEREAS, Section 11.08.040 of the Carlsbad Municipal Code states that it is unlawful
for anyone to maintain overhead wires after the date set for removal.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the City Council of the City of Carlsbad, California, hereby directs the City
Engineer to give notice in writing to the occupants and to the owners of any and all properties
which have not been made ready to connect to the underground utility system to provide the
required underground facilities within ten (1 0) days after receipt of such notice. Said notice shall
comply with the requirements of Section 11.08.090 of the Carlsbad Municipal Code.

3. That the City Council further directs that, if upon the expiration of thirty (30) days from
receipt of notice, the required underground facilities have not been provided, the City Engineer
shall forthwith proceed to do the work.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 15th day of JUNE , 1993 by the following vote, to wit:
AYES: Council Members Lewis, Stanton, Kulchin, Nygaard, Finnila

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING THE TIME TO BE READY TO CONNECT TO UNDERGROUND ELECTRIC SYSTEM IN UNDERGROUND
UTILITY DISTRICT NO. 13
WHEREAS, on September 3, 1991, the City Council of the City of Carlsbad
adopted Resolution No. 91-291 establishing Underground Utility District No. 13
and
WHEREAS, Section 11.08.030 of City Code requires that property owners b
notified of the time to be ready to connect to the underground system b.
subsequent resolution; and
WHEREAS, the underground trenching is estimated to be completed by Marc
22, 1993 and overhead poles are scheduled to be removed by June 14, 1993.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad
California, as follows:
1. That the date on which affected property, owners must be ready t
connect to underground service is March 22, 1993.
2. That a certified copy of this resolution be recorded in the Count
Recorder’s Office and also mailed to each affected property owner.
