RECOMMENDED ACTION:
ADOPT Resolution No. s3- r&r extending the term of the Open Space Advisory Committee for the peiiod of one year.
ITEM EXPLANATION
On June 26, 1990 City Council approved and made appointments to the nine-member Open Space Advisory Committee. The purpose of the committee is to advise the City Council, the Planning Commission, other commissions, boards and committees as deemed necessary, and city staff on the implementation of the recommendations of the Citizens Committee for Open Space accepted by the City Council on December 19, 1989.
In the fall of 1991, the Open Space Advisory Committee addressed the recommendations of the earlier Citizens Committee for Open Space in the Carlsbad Open Space and Conservation Resource Management Plan (OSCRMP) accepted by City Council September 1, 1992. Since completion of the OSCRMP, the committee has been reviewing and making advisory recommendations on the open space portions of master plans, specific plans and other major development proposals, to ensure consistency with the OSCRMP.
Currently, there are two unresolved open space issues. First, the committee has not made a final decision on whether equestrians should be permitted to use a greater portion of the citywide trail system. Final decision has been postponed until the City's Habitat Management Plan (HMP) has been completed. The City's HMP will address where equestrian use of trails would be prohibited due to biological impacts. Second, the committee must review how the HMP and OSCRMP will be integrated to ensure that the goals of both plans are achievable. This cannot be done until the HMP has been completed, which is expected to be in the fall of 1993.
As the Open Space Advisory Committee has not completed the above tasks, it is recommended that City Council extend the committees term for a period of one year so that the unresolved issues can be addressed. Further, staff has taken this opportunity to update the original resolution to reflect current committee roles, purpose and procedures.
I FISCAL IMPACT
Support for the committee would be provided by existing staff from the Planning Department. Postage and document reproduction costs are estimated to be $1,500.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, EXTENDING THE TERM OF THE OPEN SPACE ADVISORY COMMITTEE FOR THE PERIOD OF ONE YEAR.
WHEREAS, on June 26, 1990 the City Council created and
5 made appointments to the nine-member Open Space Advisory
6 Committee: and
7 WHEREAS, the term of the Open Space Advisory Committee
8 was for three years from the date of City Council enactment of the
9 Committee on June 26, 1990; and
10 WHEREAS, the term of the Open Space Advisory Committee
11 is scheduled to expire June 26, 1993: and
12 WHEREAS, the City Council may extend the tenure of the
13 committee if it decides that implementation of the recommendations
14 of the original Committee for Open Space have not been completed
15 or that there is a need for continuous monitoring of open space
16 policies and their implementation; and
17 WHEREAS, the Open Space Advisory Committee has not
18 resolved the issue of equestrian use of trails or the issue of how
19 implementation of open space policies of the Open Space and
2011 Conservation Resource Management Plan (OSCRMP) will be integrated

with the policies of the City's Habitat Management Plan (HMP);
NOW THEREFORE, BE IT RESOLVED by the City of Carlsbad as
follows:
1. The term of the Open Space Advisory Committee is
extended for the period of one year from the date of enactment of
this resolution. At anytime before the end of the one-year
period, the City Council may extend the tenure of the committee if
it decides that implementation of the recommendations of the
original Citizens Committee for Open Space has not been completed
or that there is a need for continuous monitoring of open space

* policies and their implementation. Furthermore, the City may, at
2 any time prior to the end of the one-year period establish a
3 permanent open space commission if such action is warranted by
4 continuous open space concerns.
5 II 2. The purpose of the Open Space Advisory Committee is
6 to advise the City Council, the Planning Commission, the Parks and
7 Recreation Commission, other commissions, boards and committees as
8 deemed necessary, and the city staff on the implementation of the
9 recommendations of the Open Space and Conservation Resource
10 Management Plan accepted by the City Council on September 1, 1992.
11 II 3. The Open Space Advisory Committee shall consist of
12 nine members appointed by the Mayor with the consent of the
13 Council. Two members shall be appointed from the Planning
14 Commission and two members shall be appointed from the Parks and
15 Recreation Commission, and five members from the community.
16 Vacancies shall be filled in the same manner. Current members
17 shall serve for one additional year from enactment of this
18 resolution unless the committee is replaced before that in
19 accordance with section 1 above.

4. The committee shall meet regularly as often as it
is deemed necessary for the transaction of business. Its meetings
22 shall be open to the public. The committee shall elect a
23 chairperson and a vice-chairperson from its membership who shall
24 hold office for one year and may establish its own rules and
25 procedures necessary for the conduct of business. Five members
26 shall constitute a quorum.

5. The committee shall act without compensation.
1 6. The committee shall act in an advisory role in
2 fulfilling the following responsibilities: Preparing advisory
3 recommendations on all plans, programs, standards and policies
4 which are proposed to implement the recommendations of the Open
5 Space and Conservation Resource Management Plan; recommending
6 extent of citywide trail use by equestrians; reviewing and
7 commenting on the City's Habitat Management Plan compliance with
8 Open Space and Conservation Resource Management Plan standards,
9 policies and guidelines: providing community representationtothe
10 Planning Commission and City Council on open space protection:
11 preparing an annual monitoring/status report on open space
12 II protection; and the implementation of any new or refined open
13 II space policies.

7. Nothing in this resolution shall be construed as
restricting or curtailing any of the powers of the City Council,
18
the Planning Commission, the Parks and Recreation Commission, or
a delegation to the Open Space Advisory Committee of any of the
authority or discretionary powers vested and imposed by law in the
above bodies. The City Council declares that the public interest,
20 !I convenience and welfare required the appointment of an Open Space

Advisory Committee to act in a purely advisory capacity to the
City Council for the purposes enumerated herein. Any powers
23 herein delegated to the committee to adopt rules and regulations
24 shall not be construed as a delegation of legislative authority

but purely a delegation of administrative authority.
