FISCAL IMPACT:
There is no fiscal impact since no changes to the current penalty schedule are being
made at this time. With the added duty of conducting hearings for parking
violations, an increased cost to the city is anticipated which will be offset by future
parking penalty modifications.
The requirement to remit $5 to the County for each paid parking citation will
continue. The County remits $2 to the State’s General Fund and retains $3 for
capital construction.

ORDINANCE NO. NS-248
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10,
CHAPTER 10.42 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDMENT OF SECTION 10.42.010 TO
CONFORM TO NEW REQUIREMENTS OF STATE LAW
ESTABLISH PARKING ENFORCEMENT PENALTIES AND
The City Council of the City of Carlsbad, California, does ordain
as follows:
SECTION 1: That Title 10, Chapter 10.42, Section 10.42.010 of
the Carlsbad Municipal Code is amended by the amendment of Subsections
10.42.010(b) and (c) to read as follows:
(b) Fees. The parking penalties for parking violations
under this chapter shall be established by resolution of the City Council
pursuant to Vehicle Code Section 40203.5.
(c) Contesting Notices of Violations; Failure to Pay.
The City Council shall establish, by resolution, an administrative review
process for contesting notices of parking violations which complies with the
require-ments of the Vehicle Code.
Failure to pay the appropriate fee as provided herein shall result
in the filing of an itemization of .Jena!ties, admivistrative and services fees
for collection by the Departmk- -)f Motor Velxlcs with the registration of
the vehicle pursuant to Vehicle ( ?de Section 4760, or in a civil action
against the registered owner if more than $400 in unpaid penalties and fees
have accrued, or in any other action allowed by law.

EFFECTIVE DATE: This ordinance shall be effective thirv days
after its adoption, and the city clerk shall certify to the adoption of this
ordinance and cause it to be published at least once in the Carlsbad Sun
within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council on the 6th day of JULY 1993, and thereafter
PASSED AND ADOPTED at a regular meeting of the City Council
1993, by the following of the City of Carlsbad on the day of
vote, to wit:

RESOLUTION NO. 93-266
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ESTABLISHING
PARKING PENALTIES
WHEREAS, the City of Carlsbad enforces parking violations
through the authority of the California Vehicle Code and the Carlsbad
Municipal Code; and
WHEREAS, effective July 1, 1993, Vehicle Code Section
40203.5(a) was amended such that the governing body of the jurisdiction
where the notice of violation is issued shall establish penalties, fees and other
charges for parking violations; and
WHEREPLS, the City Council is the governing body of the City of
Carlsbad; and
WHEREAS, Carlsbad Municipal Code Subsection 10.42.010(b)
allows parking penalties to be set by Council resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That parking violation penalties shall remain as established
by the court for bail, penalties, and assessments pursuant to prior State law
as shown in the 1993 San Diego County Misdemeanor Bail Schedule.
2. To the extent that it does not deprive anyone of a
constitutional right, the penalties are retroactive to July 1, 1993.
