CM RECOMMENDED ACTION: DEPT. t CITY A1 CITY Mc SUPPORT FOR ASSEMBLY BILL 11 33 (FRAZEE) Adopt Resolution No. 93-20 / Bill 1133 (Faazee). authorizing the Mayor to execute letters of support for 1 ITEM EXPIANATION: Assembly Bill 1 133 (Frazee), has been introduced to amend Section 6901 of the California SI Code, also known as the full crew law. The law was enacted when trains ran on steam members were needed to manually set the brakes on each car. Many states have elim revised their full crew laws because technical and safety advances have made such reqi unnecessary. California's full crew law requires common carriers operating five or more tri way on a main track or branch line to have a specified minimum amount of crew members trains. The North County Transit District (NCTD) intends to begin operating a commuter rail systen San Diego and Oceanside in the fall of 1994. AB 11 33 would make the full crew law less by causing the regulation to apply only if more than five trains operate in each direction. Ti full crew law would require NCTD to use five crew members on their commuter trains, wt increase anticipated operating costs for the project from approximately 125 to 150 percen which is exempt from the law, currently operates commuter rail trains in California with tw crews. North County Transit District officials are concerned that they will be at a disad\ negotiating with Amtrak to operate the commuter trains unless the current crew law is re1 1 133 would allow NCTD to operate their own trains with a reasonable size crew, and thus p' to negotiate more fairly with Amtrak. As California begins to move toward passenger rail transportation in its effort to alleviate congestion, air pollution, and energy consumation, many communities are looking towards commuter rail as a cost effective solution. However, the existing law on the books of California, an antiquated law dating back to the days of steam locomotives, restricts our ability to operate cost effectively. WHEREAS, Section 6901 of the State of California Labor Code requires an unr amount of crew members on trains due to technical and safety advancements, and WHEREAS, revisions to Section 6901 have been proposed in Assembly Bill 1 13: to make regulations in that section more acceptable for a commuter rail system propos North County Transit District, and WHEREAS, the City Council of the City of Carlsbad has determined it to be in interest to support Assembly Bill 11 33 (Frazee). NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of California, as follows: 1. That the above recitations are true and correct. 2. That the Mayor is authorized to execute letters of support for Assembly (Frazee).
