RECOMMENDED ACTION:
Adopt Ordinance No. NS-248, amending Title 10, Chapter 10.42 of the Carlsbad
Municipal Code to establish parking enforcement penalties and conform to new
requirements of state law.

Ordinance No, NS-248 was introduced at the regular City Council meeting of July 6,
1993. The second reading allows Council to adopt the ordinance which would then
become effective in thirty days. The City Clerk will have the ordinance published in the
"Carlsbad Sun" within fifteen days, if adopted.

ORDINANCE NO. NS-248
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10,
CHAPTER 10.42 OF THE CARLSBAD MUNICIPAL CODE
BY THE AMENDMENT OF SECTION 10.42.010 TO
ESTABLISH PARKING ENFORCEMENT PENALTIES AND
CONFORM TO NEW REQUIREMENTS OF STATE LAW
The City Council of the City of Carlsbad, California, does ordain
as follows:
SECTION 1: That Title 10, Chapter 10.42, Section 10.42.010 of
the Carlsbad Municipal Code is amended by the amendment of Subsections
10.42.010(b) and (c) to read as follows:
(b) Fees. The parking penalties for parking violations
under this chapter shall be established by resolution of the City Council
pursuant to Vehicle Code Section 40203.5.
(c) Contesting Notices of Violations; Failure to Pay.
The City Council shall establish, by resolution, an administrative review
process for contesting notices of parking violations which complies with the
require-ments of the Vehicle Code.
Failure to pay the appropriate fee as provided herein shall result
in the filing of an itemization of penalties, administrative and services fees
for collection by the Department of Motor Vehkles with the regstration of
the vehicle pursuant to Vehicle Code Section 4760, or in a civil action
against the registered owner if more than $400 in unpaid penalties and fees
have accrued, or in any other action allowed by law.

EFFECTIVE DATE: This ordinance shall be effective thirty days
after its adoption, and the city clerk shall certify to the adoption of this
ordinance and cause it to be published at least once in the Carlsbad Sun
within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council on the 6th day of JULY 1993, and thereafter
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Carlsbad on the 13th day of JIJLY 1993, by the following
vote, to wit:
AYES: Council Members Lewis, Stanton, Kulchin, Nygaard,
NOES: None
ABSENT: None
