RECOMMENDED ACTION:
Adopt Ordinance No. NS-249, amending Title 18 of the Carlsbad Municipal Code to
clarify appeal procedures for deferral of improvements.
ITEM EXPLANATION
Ordinance No. NS-249 was introduced at the regular City Council meeting of July 13,
1993. The second reading allows Council to adopt the ordinance which would then
become effective in thirty days. The City Clerk will have the ordinance published in the
"Carlsbad Sun" within fifteen days, if adopted.

ORDINANCE NO. NS-249
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 18, CHAPTER 18.40 OF THE CARLSBAD MUNICIPAL
CODE BY THE AMENDMENT OF SECTION 18.40.080 TO CLARIFY APPEAL PROCEDURES FOR DEFERRAL OF
IMPROVEMENTS
The City Council of the city of Carlsbad, Califo
does ordain as follows:
SECTION 1: That Title 18, Chapter 18.40 of
Carlsbad Municipal Code is amended by the amendment of se
18.40.080 to read as follows:
"(a) The granting or denial of a deferra
improvements pursuant to Section 18.40.070 by the city ma
shall, unless appealed to the city council in accordance
Section 1.20.600, become final ten days after the filing c
city manager's written decision setting forth the findin
support thereof.
(b) The city council shall set the matter for he
within thirty days and may approve, modify, ar disapprov decision of the city manager."
EFFECTIVE DATE: This ordinance shall be effe
thirty days after its adoption, and the city clerk shall CE

at least once in the Carlsbad Sun within fifteen days aft€
