ITEM EXPLANATION This case arises when plaintiff, an employee of Atel, was injured by an electrical shock while working on the City's telephone equipment at Oak Street on September 3, 1991. This case went to arbitration and the arbitrator awarded plaintiff $15,305 to be paid by the City. FISCAL IMPACT There are sufficient funds in the liability account to cover the settlement. CITY OF CARLSBAD CASE NO. "57045 WHEREAS, on recommendation of the City Attorney the City Council of the City of Carlsbad, California has 'determined that a settlement in the case entitled FacPhee v. City of Carlsbad is in the public interest: and WHEREAS, there are sufficient funds available in the liability self-insurance reserve account to pay the settlement, NOW, THEREFORE, BE IT RESOLVED by the City Council of d the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 3. That the City Council approves the settlement and authorizes disbursement of $15,305 from the liability self- insurance reserve account for MacPhee v. Citv of Carlsbaa. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 10th day of AUGUST , 1993, by the following vote, to wit: AYES: Council Members Lewis, Stanton, Kulchin, Nygaard, Finnila NOES: None ABSENT: None ATTEST: ALETHA L.
