ENG HOME PARK CITY MGRi RECOMMENDED ACTION: That the City Council Adopt Resolution No. ci 3 - a3 / approving an Uncontrolled Stockpile Agreement between Solamar Homeowners Association and the City of Carlsbad and authorizing the City Manager to sign the Agreement on behalf of the City. ITEM EXPLANATION: Approximately 3,000 cubic yards of dirt was illegally dumped over a slope on the eastern boundary of the Solamar Mobile Home Park. A portion of the material was placed in the A.T.&S.F. Railroad right of way. Written permission has been granted by the railroad to allow that portion of the stockpile in its right of way to remain. Grading plans showing the horizontal and vertical location of the stockpile have been prepared to the satisfaction of the City Engineer. An Uncontrolled Stockpile Agreement is required by City Code because the material was placed in such manner that it is not suitable to support buildings or structures. The applicant has been granted a Coastal Development Permit by the Coastal Commission for the stockpile. FISCAL IMPACT: None. EXHIBITS: 1. Location Map 2.
