RECOMMENDED ACTION:
That the City Council Adopt Resolution No. ci 3 - a3 / approving an Uncontrolled
Stockpile Agreement between Solamar Homeowners Association and the City of Carlsbad
and authorizing the City Manager to sign the Agreement on behalf of the City.
ITEM EXPLANATION:
Approximately 3,000 cubic yards of dirt was illegally dumped over a slope on the eastern
boundary of the Solamar Mobile Home Park. A portion of the material was placed in the
A.T.&S.F. Railroad right of way. Written permission has been granted by the railroad to
allow that portion of the stockpile in its right of way to remain. Grading plans showing
the horizontal and vertical location of the stockpile have been prepared to the satisfaction
of the City Engineer. An Uncontrolled Stockpile Agreement is required by City Code
because the material was placed in such manner that it is not suitable to support
buildings or structures.
The applicant has been granted a Coastal Development Permit by the Coastal
Commission for the stockpile.

3 CARLSBAD, CALIFORNIA ACCEPTING AN UNCONTROLLED
STOCKPILE AGREEMENT

WHEREAS, Solamar Mobile Home Park has submitted a grading plan showing the
location an uncontrolled stockpile on their property located east of Carlsbad Boulevard and south
6 of Palomar Airport Road;
7 WHEREAS, the City of Carlsbad has determined it to be in the public interest to grant the 8
9 Uncontrolled Stockpile Agreement;
10 II NOW, THEREFORE, BE lT RESOLVED, by the City Council of the City of Carlsbad, I
11 California as follows:
12 1. That the above recitation is true and correct.
13 2. That the City Manager is authorized to execute the Agreement and Clty Clerk is
14 authorized to cause the Uncontrolled Stockpile Agreement to be recorded In the Office of the
15 County Recorder of San Diego County, State of California.
16 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
17 held on the ioth, day of AU- , 1993 by the following vote, to wit:
