RECOMMENDED ACTION:
Adopt Resolution No. 93-456 authorizing the destruction of certain files.
ITEM EXPLANATION:
This agenda bill is part of a continuing Record Management Program for Cil
Departments. Adoption of the Resolution will complete the destruction of obsolete an
unnecessary files in the Parks and Recreation Department.
Section 34090 of the Government code provides authority for destruction of documen
that are more than two years 'old and are no longer required. This section also reques
the consent of the City Attorney and the authorization of the City Council prior to th
destruction of any document.
Section 34090 does not authorize the destruction of the following:

Records that affect title to real property.
Minutes, Ordinances, or Resolutions of the City Council or of any Ci
Board or Commission.
The documents listed as Exhibit "A" to Resolution No. ?&fib have been reviewed
accordance with the provisions of the Government Code, and meet those requiremer
and the City Attorney has consented to their destruction.

RESOLUTION NO. 93-256
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AUTHORIZING THE DESTRUCTION
OF CERTAIN FILES
WHEREAS, maintaining all obsolete files, correspondence, and papers is
uneconomical; and
WHEREAS, the documents listed on Exhibit "At, attached hereto and made
a part hereof, have been reviewed by the Parks and Recreation Director; and
WHEREAS, The Parks and Recreation Director recommends that a1
documents listed on Exhibit "A" are no longer required and meet the requirement?
of Government Code Section 34090 for destruction; and
WHEREAS. the City Attorney has consented to the destruction of thest
documents listed on Exhibit "A",

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Carlsbad, as follows:

That the above recitations are true and correct.
That the Parks and Recreation Director is hereby
authorized to destroy the documents listed on Exhibit
“A’, attached hereto.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City
Council of the City of Carlsbad held on the 14th day of September 1993, by the
following vote, to wit:

AVIARA OAKS MIDDLE SCHOOL ACTIVITY PLAY FIELD DEVELOPMENT PROPOSAL
As a result of the City Council's action of Tuesday, July 13, 1993,
the proposed agreements were modified based on the staff
recommendation. Please make those changes and forward them to the school district for its approval. Please be sure to get an
executed copy from the school district and return it to the City
Clerk for her files. Please send a copy of the agreement to me for my files.
