Community Church Incorporated Request for Fee Waiver
Community Church Incorporated is asking the City Council to consider waiving all building
permit related development fees which will be required for conversion of an existing
office/warehouse facility to a church facility. As a non-profit organization, the municipal code
permits a reduction in certain fees (Exhibit 1). In addition to being eligible for reduced fees,
church principals appealed and were granted an administrative exemption from an investigative
fee of $1 175.00, normally assessed to a project when it is determined that work began prior to
issuance of a permit, and stop work orders have been issued.
The City’s past practice for similar projects, has been to collect reduced fees based upon the
non-profit status of the applicant. Under normal circumstances the fees for a tenant
improvement, such as has been proposed with this project, would total approximately $37,356.
Since the applicant in this case is a non-profit organization, the fee was reduced to $24, 969,
equating to a 33% savings (Exhibit 1).
In recent years three churches have paid proportionate fees. The Carlsbad Community Church
paid over $30,000 in fees for their new facility on Pine Avenue. The Calvary Chapel facility
in the Poinsettia Drive shopping center paid approximately $23,000 in fees. And most recently,
the Redeemer by the Sea Church in the business park near the Community Development Office
paid around $12,000 in fees for a facility of about 5,500 square feet, roughly half the size of
the proposed Community Church Inc. facility.
Staff is recommending that the request for a waiver of the reduced fees be denied, since it is
contrary to existing ordinances and past practices, therefore setting a precedent for other non-
profit o izations. A waiver of fees for this project would result in a loss to the General Fund
of $24b969.

I am in receipt of an appeal dated June 17,1993 directed to the City
Manager, requesting that the processing fees be waived for the above
building permit.
These impact fees are a matter of City ordinance and cannot be waived,
however, they are minimized for certain organizations. Your permit application
proposes converting 10,082 square feet of warehouse area to church assembly area
and is assessed a valuation of $252,050. Certain fees are ordinarily functions
of this valuation, but since your organization of churches has a non-profit status,
the 3-l/2% Public Facility Fee normally assessed to these types of projects is
waived by ordinance, resulting in a savings to you of $8,821.75.
The remaining fees for water and sewer connections are additional capacity
fees due when any business intensifies their use of the water and sewer
system. The fee is based upon the occupant load and cannot be waived.
All other fees are meant to recover the cost of conducting construction
inspections.
The Building Department is willing to cancel an investigation fee of $1,175
assessed on the permit when two stop work orders to cease activity had to be
posted on the jobsite on consecutive days. Prior to permit issuance,
many follow up inspections were made to ensure compliance with these orders.
Despite the expense of monitoring these compliance orders, the investigation fee
will be waived with your assurance that construction will not progress any further
until a building permit is issued.

The Fire Department’s approval is still needed prior to permit issuance.
As Captain Mike Smith and I discussed with you at the job site, the owner
should modify the current Certificate of Occupancy to preclude uses
incompatible with church use in the remainder of the building.
