PLN AND LAND USE PLAN FOR THE BARRIO DEI CIT CIT c F& *% c 2x GL & % u@ z 0 k 0 4 d 0 z 3 - I 8 RECOMMENDED ACTION: ADOPT Resolution No. 53 -281 APPROVING an agreement between the C Carlsbad and Moore Iacofano Goltsman, Inc. for the preparation of a Comm Design and Land Use Plan for Barrio Carlsbad and appropriating funds. ITEM EXPLANATION As a result of a proposal submitted by the Barrio Carlsbad Association a conjunction with the update of the General Plan, staff is requesting authorh to proceed on the preparation of a Cornunity Design and Land Use Plan fc Barrio area. The Planning Department is beginning the last phases of the GI Plan Update which include public review of the draft revised General Plan a as public review of the Enviromnentd Impact Report. Staff believes it is apprc to prepare a community design and land use plan for the Barrio in conjunctio the Update. Although the Barrio plan will focus on design and land use, issues that affect or relate to design and land use will be considered such as safety, parks, youth programs and street improvements/maintenance. Although staff has received a preliminary land use proposal from the Barrio Cz Association, staff believes that it is important to maximize public involveme input from the Barrio. To that end, staff is proposing to utilize the con: services of Moore Iacofano Goltsman Inc. (MIG) to coordinate a corn outreach program and to assist staff in preparing a plan for the area. coordinated and facilitated the public review program for the Update of the ( Plan and staff is proposing to supplement their previous contract for assist; this effort. Attached is an outline for the work plan and the services to be provided consultant. The work plan will include programs to maximize public invol. in the Barrio to identify issues of concern, to build on strengths in the : respond to the land use proposal submitted by the Barrio Carlsbad Associat to develop a future action plan. This will be done in a two-phased program I will identify positive strengths of the area and issues of concern through one interviews, a slide show, tours, comm~ty workshops, an open hous summary presentation to the City Council. Phase I1 will include the develc preparation and presentation of a community design and land use plan to to the input identified in both Phase I as well as in the staff analysis. Staff and the consultant will be available at the Council meeting when thi considered to respond to questions on the outline or explain it in more dc 0 a PAGE 2 OF AGENDA BILL NO. 1 a; Y I g FISCAL IMPACX The cost for the consulting services to coordinate the public involvement prc and assist staff in preparing a plan is $49,800. Staff recommends that fundi] the consultant’s costs come from the following sources: 1) $25,000 from the proceeds of the 1993 tax allocation bonds. These ‘ were issued in August with net proceeds of $2.5 million. $25,000 from the general fund balance which was approximately million as of June 30, 1993. 2) A portion of the contract to study the Barrio Area and planning for future developn the area is to be funded by the Village Redevelopment Agency. The final resul provide both direct and indirect benefit to the Village as follows: 1) A significant portion of the Barrio Area is located within the existing Redevelc Area and/or the sphere of influence of the Redevelopment Area. Therefore, t! plan for the Bamo Area will need to be consistent with the proposed Mast1 for the existing Village Redevelopment Area to reduce land use cc Coordinated planning efforts are crucial to the ultimate success of both the and the Village. The proposed Master Plan for the existhg Village Redevelopment Area car implemented in isolation. The study/planning effort for the Bamo will ensi the hispanic commercial theme proposed for Roosevelt Street between C Village Drive and Walnut is appropriate and can be camed further into the Area on Roosevelt. This will benefit both the Redevelopment Area and the A strong planning effort for the Bamo Area will encourage development wh have a spill-over effect into the Village Redevelopment Area. 2) 3) In addition to the funds for consulting services, the Planning Department is also req authorization to expend up to an additional $10,000 to conduct the proposed p This will cover the cost of special notices, newspaper ads, newsletters, summa1 miscellaneous items to ensure maximum public input. GOLTSMAN, INC. FOR THE PREPARATION OF A COMMU- WHEREAS, The City Council of the City of Carlsbad, Cal determined a need for the preparation of a Community Design and Land Barrio Carlsbad in conjunction with the General Plan; and WHEREAS, a Master Plan is being prepared for the Village Re Area and a significant portion of the Barrio Area is either within and adj Redevelopment Area. PROGRESS AND C OMPLETI ON The work under this contract will begin within five (5) after receipt of notification to proceed by the CITY ai completed as agreed upon by both parties following establishment of a schedule for completion of all tasks as out in Attachment A. Extensions of time may be granted if requesi the CONSULTANT and agreed to in writing by the Planning Dirc The Planning Director will give allowance for documente substantiated unforeseeable and unavoidable delays not cause1 lack of foresight on the part of the CONSULTANT, or delays t by CITY inaction or other agencies' lack of timely action. 4. FEES TO BE PAID T 0 CONSULTANT The total shall not exceed the fee payable accordj Paragraph 6, "Payment of Fees," and shall be $49,800.00. DURATION OF CONTRAa This agreement shall extend for a period of six (6) mon from date thereof. The contract may be extended for one additional one (1) year period or part thereof, based u satisfactory performance and the CITY'S needs. 6. PAYMENT OF FEES Payment of fees shall be made within thirty (30) days ai receipt and approval of a monthly invoice submitted by CONSUL: to CITY. The CONSULTANT shall be paid for up to ninety percen the compensable services for completion of the work as set fort Paragraph 1, l%onsultant Obligations" . Monthly invoice shall bill CITY for each task complete for the percentage of each task partially completed ir preceding month. All invoices shall be detailed and incl written description of the tasks completed and tasks part completed, and the total amount of requested payment as Set in the schedule of fees (Attachment B). 7. FINAL SUBMISSIONS Within fifteen (15) days of completion and approval Community Design and Land Use Plan, CONSULTANT shall deliver CITY a camera-ready copy and Word Perfect diskette of k materials prepared during the course of the project, as P camera-ready copy of graphics and illustrations prepared 1 -3- Rev. c c project. CONSULTANT is preparing materials to support City si in preparing the Cornunity Design and Land Use Plan (guidelii concept maps and supporting drawings and illustrations), not plan itself. 8. CHANGES IN WORK If, in the course of the contract, changes seem merited bb CONSULTANT or the CITY, and informal consultations with the c party indicate that a change in the conditions of the contrac warranted, the CONSULTANT or the CITY may request a chang contract. Such changes shall be processed by the CITY in following manner: A letter outlining the required changes sha forwarded to the CITY by CONSULTANT to inform them of the pro changes along with a statement of estimated changes in charg time schedule, A supplemental agreement shall be prepared b CITY and approved by the CITY according to the procedures desc in Carlsbad Municipal Code Section 3.28.172. Such supplen agreement shall not render ineffective or invalidate unafi portions of the agreement. 9. COVENANTS AGAINST CONTINGENT FEES The CONSULTANT warrants that their firm has not emplo! retained any company or person, other a bona fide employee wi for the CONSULTANT, to solicit or secure this agreement, an CONSULTANT has not paid or agreed to pay any company or p other than a bona fide employee, any fee, commission, perce brokerage fee, gift, or any other Consideration contingent u] resulting from, the award or making of this agreement. NONDISCRIMINATION CLAUSE The CONSULTANT shall comply with the state and federal regarding nondiscrimination. 11. TERMINATION OF CONTRACE In the event of the CONSULTANT'S failure to prose deliver, or perform the work as provided for in this contract CITY may terminate this contract for nonperformance by noti the CONSULTANT by certified mail of the termination of CONSULTANT. DISPUTES The Planning Director If a dispute should arise regarding the performance 01 under this agreement, the following procedure shall be us resolve any question of fact or interpretation not othc settled by agreement between parties. Such questions, il become identified as a part of a dispute among persons ope under the provisions of this contract, shall be reduced to w by the principal of the CONSULTANT or the CITY Planning Dir -5- Rev. 6 e @ A copy of such documented dispute shall be forwarded to 3 parties involved along with recommended methods of resolution wl would be of benefit to both parties. The City Planning Directo principal receiving the letter shall reply to the letter along a recommended method of resolution within ten (10) days. If resolution thus obtained is unsatisfactory to the aggrieved pz a letter outlining the dispute shall be forwarded to the Council for their resolution through the Office of the Manager. The city Council may then opt to consider the dirt solution to the problem. In such cases, the action of the Council shall be binding upon the parties involved, alt nothing in this procedure shall prohibit the parties se remedies available to them at law. 13 SUSPENSION OR TERMINATI ON OF SER VICES This agreement may be terminated by either party tendering thirty (30) days written notice to the other parti the event of such suspension or termination, upon request ( CITY, the CONSULTANT shall assemble the work product and pU' in order for proper filing and closing and deliver said prod CITY. IO. 1993 The overall objectives of the Community Participation Program for the Barrio Carlsbad Community Design Process are to: (i) (ii) (iii) Assist City staff in preparing an implementable Community Plan for the Barrio an Educate and involve a diverse citizenry in the planning process; Provide a catalyst for Barrio area residents to discuss and articulate their views an opinions toward creating a visionary, yet realistic plan for the area’s future. The following tasks are proposed to help achieve these objectives. The budget for these t included on the last page of this document. IO, I993 c City of Carlsbad Barrio Carlsbad Community Design Process PHASE I: COMMUNITY OUTREACH AND INVOLVEMENT Task 1: Community Outreach 1.1 One-On-One Interviews The community interviews will take place early in the Community process to ensure that the community participation program respon key community concerns, constraints, and opportunities voiced by Barrio area leaders and organizers. Information gathered in the interviews will be used to develop press information and to prepan the upcoming community workshops. MIG will meet with City staff to identify interview participants, di potential questions, and review the draft and final interview questic MIG will conduct 15 - 20 interviews which should last no longer tl 60 minutes. A brief summary memorandum that details the results interviews will also be prepared. 1.2 Press Releases, Ads, Flyers This component of the outreach effort will ensure a high level of p pation in the Barrio Community Design process. For maximum pi effectiveness, the publicity effort will concentrate on distribution c information through local media channels, serving both English ar English speaking residents. A press release, announcement flyer, newspaper ad will be released in advance of the two Community Workshops and the Community Presentation/Open House. In add special notices/flyers will be sent to targeted neighborhood groups and organizations to encourage their participation in the design prc 1.3 Project Area Orientation Tour The orientation tour will be scheduled prior to the first communit workshop to familiarize City Staff, and City Council and Plannini Commission members with the Barrio project area. Participants F invited to take a walking tour of the project area led by members 1 Barrio Carlsbad Association to solicit their opinions about the are assets (strengths), liabilities, (weaknesses) and opportunities. Thi information will be used in preparing the Self-Guided Walking Tt Booklet (see Task 3.2) and in preparing for Workshop #2, Alterni Planning Concepts. City of Carlsbad Barrio Carlsbad Community Design Process Task 2: Project Presentation MIG will prepare an existing conditions slide presentation for the first Community Workshop. This presentation will summarize preliminary background information on the Barrio community area, including existing and projected data on population, housing, employment, land use, City servi etc. MIG will combine live action color slides and text, chart, table, and ma slides to illustrate this background information and data. In addition, MIG I update the slide presentation twice: one update will be made and presented i the second Community Workshop and the second update will be presented s the Community Presentation/Open House. The slide show can be easily transferred to videotape to allow for a wider distribution of the presentation material. Task 3: Community Workshops (2) 3.1 Workshop Materials Preparation h4IG will prepare workshop materials such as agendas, haridouts, a~ comment sheets to be used at the workshops. In addition, MIG wil prepare a "kit of parts" to facilitate hands-on involvement of partici during the second Community Workshop, Alternative Planning Coi Specific details on the hands-on exercise will be prepared and deve with City staff later in the Community Design process. 3.2 Self-Guided Walking Tour Booklet To further orient community members to the plan area, MIG will c an "easy-to-read-and-use" walking tour booklet. The booklet will be prepared and widely distributed to community mer and other interested persons in an effort to further familiarize the c nity to the area and solicit their comments regarding area visions, j and issues. The booklet will include a tour route map, descrip- tive text and pictures, and space for comments and questions. Infi tion contained in the booklet will be developed with input from tk workshop. It will be made available to community members betv Community Workshop #1 and #2. 3.3 Workshop Facilitation MIG will conduct two Community Workshops as part of the cor design process. The first workshop will be a kick-off event and the background/project slide presentation (Task 2) and a discussi visions, goals, and issues for Barrio.project area. . The second F will occur after the community has had a chance to participate in self-guided walking tour; it will focus primarily on the developn alternative planning concepts. The hands-on exercise using the parts" (Task 3.1) will also be conducted. m Proposed Scope of Work and Budget - Revised Sept. 10, 1993 - Pi MIG will facilitate and graphically record participant discussion on lar wallgraphics and will summarize the workshop results in a written rep including photoreductions of the wallgraphics produced during the workshop. 3.4 Workshop Reports MIG will prepare a workshop report for each of the three meetings de cribed in this scope of work: Community Workshops #1 (and walking tour) and #2, and the Community Presentation/Open House. e City of Carlsbad Barrio Carlsbad Community Design Process Task 4: Community Presentation/Open House MIG will organize and conduct the Community l%esentation/Open House. This event will provide the community with an opportunity to review the dr; community concept plan for the Barrio area. This meeting is the culminatio the Barrio Carlsbad Community Design process in that it will bring together the materials from the previous two workshops, written comments from resi participating in the walking tour, and graphics prepared by the City and MI( The format of this meeting is part presentation and part "open house." Aftex presenting the draft concept plan, open house participants will be encouragr walk around the meeting space to view the various graphics and illustration prepared by the City and MIG. City and MIG staff will be stationed near tk graphics to answer questions and receive additional feedback regarding the concept plan. Community comments will be summarized, presented to Cit! Council and incorporated into the second phase of the project, Plan Prepara Task 5: Project Management 5.1 Project Staff Meetings (4) MIG will meet with City staff to review project progress and plan for upcoming meetings and activities. Community Planning and Design Concept Development 1.1 Planning and Design Guidelines Task 1: Working closely with City staff, MIG will develop and illustrate re to community design priorities and alternative planning concepts developed during and after Community Workshop #2. The guideli will also include information gleaned from researching other cities how they have responded to similar issues, etc. The guidelines alo the concept maps and drawings and illustrations developed in Task help form the foundation of the site development plan to be prepar City staff at the conclusion of this community design effort. 1.2 Concept Map(s) MIG will work closely with City staff to prepare concept map(s) M begin to capture what residents felt were neighborhood focal point desired land uses and activities within the project area. 1.3 Drawings and Illustrations MIG will work closely with City staff to prepare a series of drawii illustrations which begin to describe the types of architecture, buil design and landscaping preferred by community residents. This ir will be included with the concept maps in the Planning and Desigi Guidelines document.
