RECOMMENDED ACTION:
Adopt Resolution No.9 3-28? , supporting H.R. 140, the Federal Mandate Relief Act of '
ITEM EXPIANATION:
The increase in unfunded federal and state mandates to cities is having a profound adversc
impact on all cities. Finance Department staff recently collected information which indicate
City spends nearly $6 million annually to comply with federal and state mandates. C
Congressman Gary A. Condit has introduced H.R. 140, the Federal Mandate Relief Act of 1 E
would provide that state and local governments are not required to comply with federal regul;
take effect on or after the date of enactment of the Act, unless the federal government pays
to state and local governments incurred in complying with the regulations.
The United States Conference of Mayors has adopted a resolution supporting the legisla
important step toward preventing enactment of any additional mandates by the federal go
Mayor Gloria McClellan of Vista is encouraging all City Councils in San Diego County to ad1
resolutions to show how strongly unified local agencies are in their opposition to new
mandates. Staff have prepared a draft resolution for Council's consideration modeled afte

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, SUPPORTING H.R. 140,
THE FEDERAL MANDATE RELIEF ACT OF 1993.
WHEREAS, unfunded federal mandates on state and local governments have bec
increasingly extensive in recent years; and
WHEREAS, such mandates have, in many instances, added to growing deficits in
local budgets and have resulted in the need for local governments to increase revenue c
services; and
WHEREAS, such excessive fiscal burdens on local governments have undermine(
instances, the ability of local governments to achieve their responsibilities under state anc
