ITEM EXPLANATION
On August 18, 1993 the Planning Commission conducted a public he&
recommended approval (6-1) of two new poIicies to be added to the text of the 1
Segment of the Local Coastal Program. Cornmissioner Erwin voted agai
policies. The two policies were proposed by the Coastal Commission staff as a I
the City's filing of a Local Coastal Plan Amendment (LCPA) to amend the Land I
for the Evan's Point project.
The LCPA for the Evans Point project, approved by the City Council on April 1
and the Planning Commission on February 19,1992, involved the redesignation (

This letter is written to express our concern to the Planning Commission for the he

II. PROJEm DESCRIPTION AND BACKGROUND
Staff is requesting a recommendation of approval for two new policies to be added to
Mello TI Segment of the Local Coastal Program. The two policies were proposed by
Coastal Commission staff as a result of the City's filing of a Local Coastal Plan Amen&
(LCPA) to amend the Land Use Map for the Evans Point project. The LCPA for the Et
Point project involved the redesignation of 128.1 acres on the southwesterly side o
Camino Red from Planned Community to Low-Medium Density Residential (RLM) on t
acres and Open Space (OS) on 59.4 acres. Also approved was a zone change from

City staff requested and received two continuances from the Coastal Commission Staff i
receiving the staff report containing the proposed modifications with the original lanp
for the two new policies. City staff did not object to the language for Policy #
Revisions to Policy #3-7 were requested. A meeting was held with Coastal staff to dis
the proposed policies and it was agreed that City staff would submit revised languagt
Policy #3-7. As originally proposed Policy #3-7 dowed no direct impacts to wetlands
riparian resources outside the lagoon ecosystems. It also fixed the mitigation ratios for
temporary or permanent disturbance at 4:l for wetlands and 3:l for riparian resour(
The policy was revised to allow disturbances for the expansion of existing circula
elements roads identified in the certified LCP and direct impacts associated with
installation of utilities. Set mitigation ratios were deleted and left to a determination n
in consultation with the California Department of Fish and Game and the U.S. Fish
Wildlife Service. The ratios are to be based on site specific information including
quality of the habitat being disturbed or destroyed and surrounding site conditions.

staff attended the Coastal Commission Hearing and requested that Policy #3-7 be amei
to allow other impacts if permissible pursuant to Section 1600-1603 of the California
and Game Code. Flexibility was needed to prevent confiicts between the proposed po
and existing policies of the LCP. The Coastal Commission on the recommendation of
staff denied the Citfs request. It will be necessary to work with the policy to see if 1
are any problems in implementing it as it has been adopted by the Coastal Commis:
III. ANALYSIS
Planning Issues
1. Does the City accept the inclusion of the proposed policies into the Mello I1 Seg
of the LCPA finding that they are necessary to provide adequate protectio
wetland and riparian resources outside the lagoon ecosystems?
DISCUSSION
The suggested modifications to the City's Local Coastal Program Amendment 91 -01 inc
adding two new policies to the Melo I1 Segment of the Local Coastal Plan. Policy
requires the protection and preservation of wetlands and riparian resources outsid
lagoon ecosystems. The LCP did not contain any policies addressing these resources u
they are in the vicinity of a lagoon. In practice, the California Department of Fisl
Game and the US. Fish and Wildlife Service are consulted if disturbance of these reso
is proposed to determine if a permit is needed from those agencies and what mitigatioi
be required if a temporary disturbance or permanent displacement is allowed. Policy
requires buffer zones to be maintained around all identified wetland and riparian i

Regarding the Agua Hedionda Land Use Plan, a 1.12 acre parcel the northern shore of Agua Hedionda lagoon, commonly known as part of "Whitey's Landing", was approved to be redesignated from Recreational Commercial to Low-Medium Density Residential. Regarding the Mello I/East Batiquitos Lagoon LCP, an amendment to the Aviara Master Plan was approvec redefine building height in Planning Areas 13 and 28 to provide consistent with recent municipal code amendments. The Commission also approved an amendment to the certified Mello I1 segment subject to two suggested
southwesterly side of El Camino Real, commonly known as "Evans Point", frc Planned Community to Low-Medium Density Residential and Open Space; also approved was a zone change from L-C (Limited Control) to R-1 and Open Spa( this property. The adopted suggested modifications are attached.
Before the amendment request can become effectively certified, the Execut Director must determine that implementation of the approved amendment wil
consistent with the Commission's certification order. This is necessary because the amendment request was certified with suggested modifications.
In order for the Executive Director to make this determination, the local government must formally acknowledge receipt of the Commission's resolutic
certification, including any terms or suggested modifications; accept and agree to those terms and modifications; and take any formal action which .
required to satisfy them, such as rezonings or other ordinance revisions. the amendment resulted in a change to the certified local coastal program area of jurisdiction, the local government must also submit a resolution

7. On page 78, under "Environmentally Sensitive Habitat Areas", a new

Don Neu, Senior Planner; reviewed the background of the request and stated that the Commissic
recall some time back acting on the Evans Point project. It was a 128 acre site off El Camino Re across from the Rancho Carlsbad mobile home park. The property is located within the Mello II I
the Local Coastal Program (LCP). As part of those actions, the Commission and Council approv
General Plan Amendment, a Zone Change, and an LCP Amendment in addition to a tentative m
related permits. Following the City approvals, the City then applied to the California Coastal Con
to amend the coastal land use map to maintain consistency with the recently approved City of C;
map changes. At the time, the Coastal staff recommended a modification which contained two r
policies to be added to the entire Mello I1 segment of the LCP. The Mello II segment takes up thc
area of the City within the coastal zone.
The two policies which were proposed at that time came about because there was no coastal pel
submitted for the project. As a result, the Coastal staff had some concerns about riparian resoui
chose to add them as policies for the entire LCP. The City had concerns about the policy languz
was drafted because it contained some specific mitigation ratios which were arbitrary and did nc
the habitat quality on any particular site. City staff went through a period of negotiation with the

to cooperate so that staff and the Coastal Commission can work out something later on which is
acceptable. Their primary reason for opposing the wording in the policy is stated in their letter d
August 17, 1993. Since staff is willing to work towards getting the policy changed in the future,
that this would be preferable. Ms. King pointed out that the Evans Point residential project was (
designed to avoid all wetland impacts and they would have been in conformance with Policy #3-
However, they recently found out that there were some wetlands which had not been mapped. E
now trying to revise the design to bring it into conformance. She believes that there are extenua
circumstances in the Evans Point project which would be grounds to change the amendment. S
supports the staff recommendation.
Commissioner Schlehuber understood staff to say that if the Commission doesn't act on this am6
