Receive presentation by Kathy Fallon regarding advisory vote on LEGO Family Park.
ITEM EXPLANATION:
The City Manager has received a request from Kathy Fallon to address the City Counci
regarding a City-sponsored advisory vote on LEGO Family Park.

Dear Mr. Patchett:
Enclosed is a copy of my remarks to the City Council on September 27, 1993. During the open comment portion of the meeting I informed the Council
that I would follow my remarks with a letter to you requesting that an item be
placed on the Council agenda by October 12, 1993.
Please add an agenda item, at your convenience, by October 12, 1993. The
agenda item is to offer citizens and Council the chance to participate in a
dialogue over a council sponsored advisory vote on the November 1994
ballot. The advisory vote would allow citizens to register their formal,
quantifiable opinion of whether they wish to see a LEG0 World theme park
developed in Carlsbad.
I believe that it is important for both the Council and the citizens of Carlsbad to
have a formal opportunity to discuss the various options available to them
regarding the LEG0 development. Although this discussion may not lead to a
resolution of the issue, it may serve as an opportunity to reunite the citizens
and their leaders. Without this opportunity, further dissension between the city
and it's constituency is virtually guaranteed.

I am not asking you to decide on LEGO. I realize that you may not be
the council that ultimately decides the fate of Lego. I am only asking you to
allow the citizens io vote on the issue. You are the council that can secure
this right. It is not too eurly to ensure that the people huve a vote on this
issue. In fact, it is almost too late. If Lego decides to come to Carlsbad, the
planing process will be nearly complete by the 1994 election. By then the
citizens of Carlsbad will have all of he information they need to vote. They
will also have had the same opportunity that I have now, 3 minutes to voice
my concerns. But under the planning process alone, 3 minutes is all they will
have. With an advisory vote on the 94 ballot citizens will also have a piece
of the decision making power.
Why must you decide to put this advisory vote on the ballot before the
end of October?
Because if you should continue to decide to ignore the wishes of the
people, we are left with onty one alternatives. We must design a ballot
process, by your own calendar, must start by November 9, 1993 to make it
through all the numerous hoops required to make the 94 ballot.
So, why an advisory vote? Putting an advisory vote forward now,
shows the citizens of Carlsbad that you think that they are entitled to share the
decision making in this issue. I am not asking that every planning issue at
stake be made a part of the 94 ballot.

The city has spent $5000 on a Price Waterhouse analysis of the LEGO
project. And the list goes on.
Any project that stirs this kind of activity and warrants this level of
public spending before plans have even been filed with the city, certain/y
warrants a an advisory vote by the citizens.
find out what the citizens of Carlsbad want is not an unreasonable request.
Remember, I am not asking you to vote on LEGO, I am asking you to vote for
the citizens of Carlsbad. An advisory vote on the LEG0 project is your
decision.
You stand to make immeasurable gains by simply honoring the citizens
wishes and making room for them on the 94 ballot. And it's not going to cost
anyone a cent if LEGO decides not to come to Carlsbad. No one loses with
an advisory vote. However, you stand to lose a great deal if you should

November 18, 1993 Proponents file with the City Clerk a Notice of Intent and te:

December 3, 1993 The City Clerk provides the summary and title to Initiatii

June 1, 1994 Deadline for filing petition with City Clerk’s Ofice (calculate
as 180 days from the date the proponents receive the Title an

July 12, 1994 If petition found to be sufficient, City Clerk certifies th

The City Council may refer the proposed measure to staff fc

August 9, 1994 Deadline for presenting report to Council for action on th
proposed measure (and last regular Council meeting prior t
the deadline for taking action to place measure on the ballot:
August 12, 1994 Registrar of Voter‘s deadline for receiving documents placiq
items on the ballot for the November, 1994 election.
The above calendar merely contains dates in accordance with specific time frame
established in the Election’s Code. It is not intended as an all-inclusive guide for all action
that must be accomplished by proponents.
