ITEM EXPLANATION: The State of California Department of Transportation (CALTRANS) requires that the City submit Certification forms stating the City has secured possession of all properties needed for projects constructed within their right-of-way. This includes the 1-5 Interchange widening projects and other federally funded local streets and road projects. CALTRANS also requires that the City Council adopt a resolution granting authority to sign these forms. Staff is recommending that Council designate the City Engineer to execute the Right-of-way Certification forms. FISCAL IMPACT There is no fiscal impact resulting from this action. 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbac California, as follows: 1. That the above recitations are true and correct. 2. That the City Council hereby designates the City Engineer as the City offici: authorized to execute on behalf of the City of Carlsbad Right-of-way Certifications for CALTRAN and federally funded local streets and road projects. Engineering Inspection will take over the tracking responsibilities for bond releases for Capital Projects and Development Projects. This will occur when you provide me with the current bond number and status for each bond you are currently tracking. We will then notify you of bond reductions and releases and you will take the necessary action. As always, you will provide us with copies of all Notice of Completions. We will pursue the standardization of types of bonds and their terms with the City Attorney and C.M.W.D. 2. 3. Thanks for meeting with us, hope this streamlines the process. v= RICHARD E.
