ITEM EXPLANATION Attached for the City Council's review and approval are two (2) amendments to agreements for final design services to complete the project plans, specifications, and documents for the future construction of Poinsettia Community Park and Hidden Vallt Amendment No. 5 for Poinsettia Community Park is required for the City's project ai to perform the following design additions and modifications to the project plans: 1. Retention of a subconsultant to perform a paleontological resource investiga final report of the project site. This report is a requirement of the project's COI Use Permit and Planning Department review of potential site resources. 2. Preparation of a geotechnical report and furnishing design calculations for the IC retaining walls on the project site. This report is a requirement of the En{ Department's review of the final project design. 3. Modifications to the proposed irrigation system design to include a pumping si required by the Carlsbad Municipal Water District. 4. Creation of sewer easement documents with accompanying legal description onsite sewer pump station, sewer transmission lines, and site access as requirc Carlsbad Municipal Water District. 9 8 0 Is: $&. z 0 0 F a 6 z 3 5. Modifications to the design of the water service meters for both potable and r lines with design connections to facilities from Hidden Valley Road into the pa required by the Carlsbad Municipal Water District. Amendment No. 1 for Hidden Valley Road is required for the City's project engineers tc the following design additions and modifications to the project plans: 1. Revisions to the project plans regarding the future phasing of the improvement: Camino De Las Ondas as it connects with Hidden Valley Road. These modific: the timing of installation of these improvements. necessary due to the current processing of tentative maps on adjacent propf 2. Undertake borings, take soil samples, testing, and provide a geotechnical repc area along the alignment of Hidden Valley Road for the purposes of recom pavement sections. Preparation of exhibits, letters of permission, and coordination with affected p owners for the use of the existing 6" water main which will be affected duril construction as required by the Carlsbad Municipal Water District. 4. Design of a temporary water high line for use by affected property owners construction as required by the Carlsbad Municipal Water District. These various design modifications are the final changes and additions to the construction documents for both Poinsettia Community Park and the accompanying Valley Road. The final changes will require approximately 30 calendar days to coml which time the project plans, specifications, and contract documents will be resubmi the final City plancheck. Staff recommends approval of the attached amendments existing agreements. FISCAL IMPACT The total cost of Amendment No. 5 with The Dike Partnership for the above referencec Amendment No. 1 with Crosby, Mead, Benton and Associates for the above refetencec of work for the Hidden Valley Road plans is $1 4,800.00. Sufficient funds are cc appropriated to project accounts 320-820-1 823-3348 and 342-820-1 843-3409 respe to enable the funding of the required attached agreement amendments. EXHIBITS 1. II e 0 AMENDMENT NO. 5 TO AGREEMENT FOR DESIGN SERVICES FOR POlNSElllA COMMUNITY PARK THIS AMENDMENT NO. 5, made and entered into as of the 26th day of OCTOBER , 1993, by and between the CITY OF CARLSBAD, a municipal corporation, hereinafter referred to as "City," and THE DIKE PARTNERSHIP, hereinafte referred to as "Consultant." RECITALS WHEREAS, the City Council of the City of Carlsbad, California, adopted Resolutior No. 91 -386 on December 3,1991, approving a consultant agreement for the developmer of a Master Plan and supplemental design services for City's Poinsettia Community Park and WHEREAS, the parties to this aforementioned agreement did previously enter intc Amendment Nos. 1 , 2, 3, and 4 to expand the scope of work for the design of said project; and WHEREAS, the parties to this aforementioned agreement desire to expand the scope of work to include Amendment No. 5 for preparation of supplementary design work to include final geotechnical, civil engineering, water, and sewer design services required to complete the final design of said project; and WHEREAS, a supplemental scope of work and fee schedule have been negotiateG and agreed to between the parties hereto and is described herein; and WHEREAS, the City Council of the City of Carlsbad hereby finds it necessary, desirable, and in the public interest to proceed with this Amendment No. 5 for said additional work. (1 1 e 0 NOW, THEREFORE, in consideration of these recitals and the mutual covenant: contained herein, City and Consultant hereby agree as follows: 1. Consultant shall provide or cause to be provided to City all supplement2 design services as stated herein for the aforementioned project. Said additional service: shall include: A. Paleontological resource investigation and report as required for al properties to be developed within City’s Growth Management Zone 20. B. Geotechnical review and design calculations for the loffelstein retaining walls on the project site. C. Modifications to the irrigation system design to include a pumping system. D. Creation of sewer easement documents and legal descriptions, plats, and related documents for the sewer pump station, sewer transmissior lines, and site access. E. Design of water service meters for both potable and reclaimed line: with design of connections to facilities from Hidden Valley Road into the park site. Work is to include revisions to the water service easement documents to reflect meter locations. F. Reimbursement of costs for blueprinting, reproductions, fax and delivery charges, and related miscellaneous document preparation costs required for items A through E above. 2. City shall pay Consultant on a time and materials basis, not-to-exceed a total (2) 0 a of $13,685.00 based upon the following: A. Paleontological Report $ 895.00 B. Geotechnical Review of Retaining Walls I $ 750.00 C. Irrigation and Pump System Design $ 3,600.00 D. Sewer Easement Documents $ 3,360.00 E. Water Service Design $ 4,280.00 F. Printing Reimbursable $ 800.00 3. For the purposes of the Amendment, Consultant shall not exceed the total cost as described in Paragraph 2 above without prior written authorization of City. 4. Consultant shall complete all work under this Amendment for approval by City within thirty (30) calendar days of the date of execution of this Amendment No. 5. 5. All provisions of the aforementioned agreement entered into on December 3, 1991 , by and between City and Consultant shall remain in full force and effect. 6. This Amendment No. 5 to the aforementioned agreement between City and Consultant shall be effective on and from the day first above written. City Clerk (3) 0 0 AMENDMENT NO. 1 TO AGREEMENT FOR DESIGN SERVICES FOR HIDDEN VALLEY ROAD THIS AMENDMENT NO. 1, made and entered into as of the 26th day of OCTOBER , 1993, by and between the CITY OF CARLSBAD, a municipal corporation, hereinafter referred to as "City," and CROSBY, MEAD, BENTON, AND ASSOCIATES, hereinafter referred to as "Consultant." RECITALS WHEREAS, the City Council of the City of Carlsbad, California, adopted Resolution No. 92-266 on September 1, 1992, approving a consultant agreement for the development of plans, specifications, and contract documents for the improvements to Hidden Valley Road northerly from Camino De Las Ondas associated with the City's future construction Poinsettia Community Park; and WHEREAS, the parties to this aforementioned agreement desire to amend the scope of work to include this Amendment No.1 for the preparation of modifications to the project plans, specifications, contract documents, and related project information and data; and WHEREAS, a supplemental scope of work and fee schedule have been prepared, negotiated, and agree to between the parties hereto and is described herein; and WHEREAS, the City Council of the City of Carlsbad, California, hereby finds it necessary, desirable, and in the public interest to proceed with this Amendment No. 1 for said additional work. (1 1 0 0 NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Consultant hereby agree as follows: I. Consultant shall provide, or cause to be provided to City, all supplementa design services as stated herein for the aforementioned project. Said additional desigr services shall include: A. Revisions to project drawings regarding the phasing of improvemeni to Hidden Valley Road and frontage along existing Camino De Las Onda: Revisions to drawings shall include curb returns, storm drains, reclaimec water lines, water connections to existing lines, erosion control, and traff control plans. Make all modifications to key mapping, title sheet, sheet index, and sheet numbers to reflect these revisions. 6. Undertake borings along Hi,dden Valley Road alignment to take samples regarding soil composition and conditions. Provide "R-value" testing, analysis, reports, and make recommendations for pavement sections. C, Coordinate with property owners along the existing 6'water main fs water needs during road construction. Secure letters from affected proper owners verifying water needs during construction. Prepare all letters an exhibits as necessary. D. Design a temporary water high line in association with the CarlsbE Municipal Water District for use during construction. Provide all (2) 1 0 0 . supplemental design and drawing details necessary for this facility. E. Provide to City all necessary blueprints, reproductions, exhibits, anc related drawing modifications, including processing and delivery, requirec to accomplish the above scope of work. 2. City shall pay Consultant on a time and materials basis, not to exceed a total of $ 14,800.00 based upon the following: A. Phasing and Plan Revisions $ 4,200.00 B. Supplemental Soils Testing $ 3,000.00 C. Temporary Water Service Coordination $ 2,100.00 D. Water High Line Design $ 4,700.00 E. Reimbursable Expenses for Reproductions $ 800.00 3. For the purposes of this Amendment, Consultant shall not exceed the tot2 cost as described in Paragraph 2 above without the prior written authorization of City 4. Consultant shall complete all work under this Amendment No. 1 for approv; by City within sixty (60) calendar days of the date of execution of this amendment. 5.
